    Trouble with a Creditor *sigh*

    We filed on 5-5-08 ch7. First this creditor tried saying our business signed for the loan, not us personally. Whatever, the business no longer exists, what could they seriously do. Now I get a letter from our atty. yesterday saying they are saying the amount we filed on is not correct. OMG! Do they seriously expect me to figure out exactly what we owe? As far as I'm concerned, we're close to the amount and the account number is correct. I can see this company filing a complaint/abuse on the 60th day.

    Anyone else deal with a pain in the A** company like this one? I just want to get past my 60th day and get this all over with and move on with my life!
    May 5, 2008 - Filed Ch7
    June 13, 2008 - 341 Meeting
    August 12, 2008 - Last day for objections... August 18, 2008 - Discharged!
    August 26, 2008 - CASE CLOSED!

    Amounts are not necessary on the filing, however it they are making a big issue of the matter, the lawyer should be able to amend the filing with the proper amount. Just have your lawyer request the proper amount from them and then amend the filing I think

    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      If they make a serious issue out of the amount you owe, ask your atty if he can "over estimate" how much is owed. That way, you can amend the petition and are covered either way. Personally I think its ridiculous for them to ask you to list the "exact" amount anyway because sometimes interest and penalty charges can affect your balance significantly depending on the amount you owe.

        When we filed on 12/28/07 and included our medical bills--my broken arm and knee in August, and 'Hub's abdominal skil-saw accident in November--our attorney simply filled in $1.00 as an amount for each of the medical providers that were listed. We did that because insurance was still pending in every instance and we couldn't even begin to guess at what the totals would be. Once they were notified of our BK the medical providers sent paperwork into the Court to list the amounts owed. We thought we would have to ammend to add those firgures once we got them. It turned out not to be necessary.
