    Utility company NOT accepting our BK!

    Well either they dont understand or they just dont care.
    Heres the scenerio:
    Filed on May 29th. We did not include a $892 gas and electric bill because we were going to do payments of $10 extra a month as arranged by them. Figuring this would be easier than adding them to our Matrix.

    June 29th we get a notice that they are going to be shutting us off...Apparently none of the payment agreement that we signed and returned certified was received

    July 4th we decide there is no way to come up with this past due $892.we will just add them to our matrix ourselves and skip the attorney because he charges $200 to add a creditor

    Today my husband calls and they refuse to take the BK # !!! they want nothing to do with the BK... they want money. Mind you they do not know they are not in our Matrix at this point. We will add them ASAP BUT.... in the meantime they may come and shut off our utilities because they refuse to accept that we have filed BK no asset chapter 7.

    I really dont want to call the attorney because of the $$$$$ it will cost. I figured we could do this ourselves but how do I get this HUGE Gas and Electric company to take my BK serious?

    Any ideas?

    EDIT: Just called our local BK court to find out about adding a creditor. They strongly advise going through our attorney. I really dont want to do that.

    It's probably better to do it with your attorney.

    I don't know the exact method, I think it costs money and you have to take an amended form down to the courthouse, local forms might need to be amended too.

    Did you keep copies and the receipt from certified mail about the agreement?
    May 31st, 2007: Petition Filed by my lawyer
    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.

      It costs $26 to amend and I understand that is a one time fee no matter how many you add. Now about the attorney, in our State, they are stuck with us by law until we are done. In fact I cannot even fire mine without going to Court. I will look up this law and post it here by and by.

      The utility company by law cannot turn you off, however if you do not pay the current bill from notification they can turn it off in 20 days of a no payment, but that is after they are informed. No the company has not recieved notification from the Court so they are not "officially" notified, but they should honor your case number and I would find that green card and state you will be going to the Public Service Commission about their ingoring of law. That has more power to them I think then bk. You might make a copy of your bk notification letter and duct tape it to the seal of the meter and take a picture holding today's newspaper as a time stamp with the meter in the picture.

          OK 'mom; as was done with us, they made us pay a deposit after 42 years of living in the same place. But, such as it is, this they will do. So, they worked with me to pay the deposit in payments. Not fun at all and the worse part of this, as we are an asset case, they called our deposit an asset and we have to pay to get it back. We will be paying 580 to get 760 back on our deposit. We are 7 asset case. 'Hub

            I would also advise using your attorney for this.

              I would use the atty. to file the amendment, but be warned: the utility co. can still charge you a horrendous deposit and get back at you that way. They did it to me, but do what you have to do to keep your lights on.

                I'd contact your states public utility commission or attoney general's office for help.
