    Stopped receving bills from creditors that I didn't want to stop!

    We filed Chapter 7 on 5/23/08. We have a 2nd mortgage through Wells Fargo (the 1st is through Wells Fargo as well).....anyhow, we stopped getting our monthly statement for the 2nd mortgage as well as both our lease statements from GMAC.....why is this? We are going to fall behind if we don't get these statements and it's too hard to keep track of when they are due. Do we have to send some kind of letter or something telling them to send the statements? If so, what kind?
    Any help would be greatly appreciated!

    They can't send you a bill while the automatic stay is in process. You probably can call them and ask how much and what the due date is. Might need to talk to their bankruptcy dept.

      If you have a copy of any statement from these creditors, run a copy and mail it to the mailing address with your payment. They will not send a paper statement until your discharged, it's illegal for them to do so. Just make sure you make those payments. Surely you can find some paper with your acct on it and use that. I have already planned for this and have a stack of statements to use to keep our payments current.

        That happened with us as well, though not with mortgage or lease situations like you. Our were for a couple of small accounts with Lowe's and Radio Shack. In our case it turned out that their credit/collection--whatever its called--is handled by a larger parent that handled some of the other debts we did wanted discharged, and so the parent notified all of our BK.

        In your situation, did you reaffirm the mortgages and the lease agreement? If you did, you should be on schedule. If not, and you are attempting a 'ride-through', I would either go in person and talk to the lender, or at the very least, get on the telephone and talk to their credit department.

          Often eventually the mortgage company MAY send you "informational statements" every month showing when they posted your payment and to which mortgage accounts. But the days of having a payment book are over for the duration of your Ch 7. Most mortgage and car lenders block online access to make payments while your bankruptcy is active as well.

          You absolutely MUST remember on your own to pay your mortgage and other secured bills on time and to the right company address to prevent foreclosure or repossession of those assets. This is particularly crucial if you did NOT sign a reaffirmation agreement for any of the assets.

          Many of us use online banking through our bank or credit union to make these secured payments every month - does your bank/cu offer this (usually free) service?

            Seems to me they would have to send you some type of statement showing the escrow activity at the very least.

            Also on mine I get conflicting info. First said that the mortgage payment will still be automatically taken out, today didnt see taken out so i called. CSR said no it wont be auto taken out. I said fine, I just need to know so I make the payment but she must 100% telll me it wont be taken out so i dont have mortgagex2 coming out of my acct. 15 minutes later on hold her talking to her sup the autopayments will continue. So I told her I want our conversation noted and i will monitor my checking acct to see the cash go out. I told her I havent been late with them all this time and even though filing, I do not want to be late now!

              Update, my July payment was autowithdrawn from my checking yesterday as promised.

              I guess not all mortgage companies are the same and if you want them to continue auto wd a call could help. I will continue to monitor closely of course

                I've called mine and they have done a check-by-phone payment without any additional charges. You could call your creditors and ask for an informational statementto be sent monthly, but generally, the secured assets (cars, mortgages) typically have a fixed due date every month. So it shouldn't be too difficult to keep track of.

                Credit cards, HELOCS, etc can vary (in my experience)

                  I had several accounts with Wells Fargo when we filed. They are transfering your accounts to their bankruptcy department. Your lawyer will soon get a letter telling you that they have discontinued any automatic payments and giving you the billing address of their bankruptcy department.

                  I found their bankruptcy department pretty easy to work with. I had one car payment I had to mail at christmas time. It arrived two days after the next months payment. They told me the mailing problem wouldn't adversly effect my filing, or my payment history and it didn't. They then let me know that if I prefered I could make a payment over the phone. They don't charge for that service. I did that for the rest of the time until our bankruptcy was discharged and headed back to the normal billing department (if you reafirm, if you don't reafirm it stays with the bankruptcy department).
