    My 341 Last Week - Filed Pro Se

    My 341 went pretty well last week. The trustee was professional (not mean). She asked me very general questions - one in particular that may interest people on the board was whether I had bought a new car in the last six months - which I hadn't.

    She didn't probe about any of the things I was worried about (ie tax/rebate refunds/means test). But one thing that did come up was why my husband didn't file and does he own any property that wasn't included in my petition? He didn't want to file because he's damn stupid and didn't want to ruin his credit. We are in a community property state and while he does not have any money or property - he does own some old vehicles and farm type equipment none of which amounts to much. He either owned them before we were married or inherited some stuff during our marriage from his uncle's death. So since they were his sole & separate property - I did not know I had to list them on my bk petition.

    She asked to see an accounting for him which is fine by me. She is just doing her job and I guess wants to make sure that he doesn't outright own anything brand new, acquired during the marriage via community funds, that could be sold. Or that I was not hiding anything in his not filing. My husband is a junk collector and half of what he has doesn't run & sits idle.

    Other than this - the 341 was not too painful (although my husband is none too happy about it and the way I feel is oh well - he shoulda filed with me). I plan on sending her copies of titles of his stuff along with his uncle's death certificate and hopefully we'll be done with it. I'm pretty sure she won't care about his items and pretty sure she can't touch them anyway because they aren't items that fall within the community property and this can be easily proved.

    Danaf, forgive me for not remembering....you said you live in a community property state but filed alone. Is all (or at least the vast majority) of the debt you filed on from before you were married? (Please say yes!)

    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      yes - I've only been married a short time. Most of the debt is from when I lived in NY. All cards opened long time ago, before I ever met my husband.

      In any case - he is aware of the consequences and still chose not to file.

              Congrats on getting through your 341 and doing what needs to be done, even if DH isn't a fan. I hope it is smooth sailing the rest of the way!

                      Congratulations and I admire you for filing pro se. I am a very similar situation but it is my wife’s debt that pushed us over the edge. In this state she has financial interest in property even thaw it was premarital She was going to file a couple of months ago but then we decided to file together and just wipe the slate clean. I think I was kidding myself to think I was in any better shape then she is. I am quite honestly tired of letting the Credit Bureaus run my life.
