    Medical Bill discharged???

    My Chapter 7 bankruptcy was discharged on March 15 of this year.

    About a month earlier, I had to go to an emergency room and my health insurance did not pay all this bill. I still owe about $1600.

    Even though I did not add or declare this medical bill to my debts list, since it was incurred a month before my bankruptcy discharge, is it automatically discharged along with my other debts?

    Thanks in advance for any help or advice you can offer me!

    My understanding is, unless you included this debt in your bk filing, it is not automatically discharged. If it wasn't on your matrix, unfortunately you still owe it.

    That's just how I interpret the discharge it anyway.

      The operative date is the date you FILED bk. Any debt incurred after you filed (which it sounds like is the case here) is not part of your BK and therefore not discharged.

        If the debt was accrued after the filing date you still owe it. Debts accrued after the filing date are not included in discharge.

        If the debt was accrued prior to the filing date it depends. If you were a no asset case then there is precedent that it is discharged. If you were an asset case then the precedent is that you still owe it since they did not get opportunity to receive some assets.
        May 31st, 2007: Petition Filed by my lawyer
        July 2nd, 2007: 341 Meeting Held
        September 4th, 2007: Discharged and Closed.
