    Help! Trustee Never Filed His No Asset Report and I Should Be Discharged By Now.

    I should be discharged by now. Last day for creditors to object has come and gone (6/13). I called the clerk's office today to ask what was going on. Clerk told me that Trustee has yet to file his No Asset Report and they cannot discharge me until he files it...WTF????

    My 341 was 4/14. Trustee filed his meeting minutes on 4/16 (this was a non viewable document on PACER). That was the only document filed by the Trustee. For the record, my meeting went well...lasted less than 5 minutes and I have zero assets nor do I own anything of value.

    How in the world did my case slip through the cracks like this? Who do I speak with at the Trustee's office to fix this (since I'm sure I don't talk directly with the Trustee)?

    There is a problem here right?

    Why don't you start with your attorney if you have one? You can call the trustee if you want. That info is in Pacer. Also have you checked the docket report. The docket is the record which shows all the activity concerning your bankruptcy. You probably have but just checking. You're right something should have been notated by now. My trustee updated my status 2 days after my 341. I feel pretty thankful about that. Calling the trustee is an option if you want. When I called the clerk's office to ask about something the trustee and she asked if I wanted her number. I said no. Didn't want to attract an unwanted attetion to my case.

    The good thing is your creditors can no longer object to to your debts. At least this is what my atty tells me. My last day to object was 6/27/2008.

    Hope you get this all cleared up soon.

      Sounds like the Trustee may have lost your file in the shuffle. I'd get on the horn with your lawyer and see what is up. If you filed pro se call the Trustee's office and see what the issue is. It is possible he may also have been injured or out due to illness. However it should be smooth sailing I'd think.

      September 4th, 2007: Discharged and Closed.
