    Filing Ch7 but still owe BK attorney money?

    I'm preparing to file for Chapter 7 as soon as possible. Do I have to wait to file until I've paid my attorney everything? Saving up approximately $3000 could take a while!!! I'm just so eager to get the ball rolling!!

    Attorneys have to be paid in full and you have to pay filing fee, before a BK can be filed.

      Isn't the Fee caped at $1500.00 filing fee included?

        I dont think so....Our fee was $1800~

        All fees must be paid before the lawyer will file.

          Mine is $2080 for personal CH7. They required $200 down which allows me to pass all my creditor calls to my attorney and $200 minimum a month after that. Total balance must be paid before the attorney can file with the court and proceed with the CH7.

            Is there any way to find a less expensive attorney? Or search for a volunteer legal services in your area? I am not sure how long its going to take you to save the $3000 but that does seem a little on the higher end of attorney fees.

              No, I paid 2300. Where do you read there is a cap on the fee?

                I did not read it I was told that by 3 attorneys I had consultations with. Could this just be in my state?

                      WOW JK! I live in Newport Beach CA and the average CH7 was about $1950. Mines a no asset CH7 and will cost me $2080.

                        I know in LA there are a few 3k attorneys. I don't know what the most is in San Diego. To some my attorney was expensive, but I figure if I get discharged from the huge amount of debt I have, his fee will be well worth it.

                          There is no cap on chapter 7 fees, but each district sets a local cap on chapter 13 fees for the "basic" services a chapter 13 should include.

                          Generally speaking, a chapter 7 attorney gets paid in full before the case gets filed.

                            I am in south central PA the 1500 is for chapter 7 "basic" the 1500 includes the filing fee and it has to be paid before the filing.
