Question on status on Pacer..

Ok, after reading someone else's thread that just finished their 341 meeting and already has an "awaiting discharge" status, I'm kinda nervous....

We have 20 days to go out of our 60 days and our status still says "Voluntary Petition: Days in status: 94"....

Has anyone not seen an "awaiting discharge" status and still been discharged??

perhaps your trustee is swamped right now. But you can always call the court and ask as well as your attorney. As long as you don't see US trustee, you are probably ok.

I think the Trustee might be too busy to update it. I think it'll be okay. I saw Awaiting Discharge on PACER the 2nd day after my 341, but I think that's because she's really thorough.

Don't worry, like gramma said, as long as you don't hear from the UST, you'll be fine. I've got 11 days to go and I'm getting anxious.

Our trustee filed this the day after our 341:

An initial 341 examination was scheduled for 5/15/2008. The trustee reports that the examination was completed and the 341 Meeting is concluded. The trustee also reports a No Asset Case. The trustee has not received any money or property. WHEREFORE, the Trustee certifies that pursuant to F.R.B.P. 5009, this estate has been fully administered, requests this report be approved and that the Trustee be discharged.

But, when I click on "status" in Pacer, it shows this:

There's a "blank" next to the 3-22...

Stilltheone, my PACER acct *never* showed Awaiting Discharge! But I got my discharge on time anyway. So it may actually be "the way they do things" down at your district courthouse, as far as applying PACER flags goes. It may also be the trustee who sets that flag himself, and not the court clerks.

But don't worry about it until a couple of weeks after your 60 days is up; at that point call your case manager (their number should be listed on your district's website) and ask them *very sweetly* when you can reasonably expect discharge. Actually, you could call today if you're really concerned about it.
