My attorney forgot to file my financial course to the court in time for my discharge!

    Im on a payment plan, paid I think 1200 upfront, then 200 a month afterwards.

    I called the bankrupcty court myself this morning! My account was still pending they didnt close it!!!!

    My attorney said they would file it...I was going to go up there myself, I called back up there around 11:30 and spoke to the clerk and they said the attorney just filed it this morning!!

    Now....whats next?

    I hope the discharge will soon follow??

        Ok I just went into the PACER system, looks like my case was closed today now??

        How do I know if it was accepted or not?

        Here is a couple of the things I found in it:

        Case type: bk Chapter: 7 Asset: No Vol: v Judge: XXXXXXX
        Date filed: 02/28/2008 Date discharged: 06/18/2008
        Date terminated: 06/18/2008 Date of last filing: 06/18/2008

        I am guessing because it shows a date of discharge it is final and I am clear of my debts? How would I know if it was approved or not?

        Also another thing I found in the system:


        In Re: XXXXXXXX
        Debtor(s) Case No.: XXXXXX
        Chapter: 7
        FINAL DECREE
        The estate of the above−named debtor has been fully administered.
        The deposit required by the plan has been distributed. (Chapter 13 Only)
        IT IS ORDERED THAT:
        XXXXXXXX is discharged as trustee of the estate of the above−named debtor and the bond is cancelled;
        The chapter 7 case of the above−named debtor is closed.
        Signed and Entered on Docket: 6/18/08

          freni32: to me, it looks like you are DISCHARGED!!! Yea!!! Now let some of the more experience members chime in on their take. Also, if you are still on the board, please go back into 'Edit Mode' and XXXXX out the names. The Moderators really don't want people identified by name. Thanks.~~~

                Faxes are notoriously unreliable AND people on the other end sometimes say they did not get them even though they did - but they lost them or misfiled them.

                So call the Trustee's office to make SURE it was received and ask them if they can fax you back a receipt of said document for proof of receipt.

                Then keep your eye on Pacer.

                  Freni, YES, you are discharged and closed!!!! YAAAAAAY!!!!

                  To PaKettle, JRScott, Logan, and anyone else who's interested, don't fax your debt ed certificate to the trustee. It has nothing to do with the trustee. The trustee is not the court, he/she just works for the court, so sending the trustee something is very different than filing something with the court. As I said earlier, the debt ed certificate MUST be filed with the court, or it doesn't exist. The trustee is not your attorney, he/she will not file it for you.

                  The only things you give straight to the trustee are documents and data that he/she asks you for specifically, plus tax returns and paycheck stubs. Everything else required by bk law must be filed with the court, just like your original petition.

                  I don't mean to be sharp, but it's an important distinction: if someone comes behind you and reads this later, and sends amendments and debt ed certificates and God-knows-what-else to the trustee thinking they've got it covered by doing so, they're in for a horrible shock when they need it least. So, be forewarrned.

                      No problem, AngelinaCat. One sure clue is that anything that has a form involved (such as Form 23 for the debt ed certificate) gets filed directly with the court. BTW, I meant to tell you, good call on editing out the real names!

                        Thank you all so very much! I called my attorney as well and I actually knew it was discharged before they even had a clue about it! So the Pacer system is very well worth it!

                        Thank you to all the feedback and help! much appreciated!

                        I hope to help out others on the board now here and just start learning about rebuilding credit and start fresh again....and do it right this time! I got caught up in debt from living on my own during college, then the debt from college full time and the expenses with not much money coming in....adds up very quick...feels great to have a fresh start! I was able to remove around 45k in debt that was discharged. I dont ever plan on using credit cards again, they can increase the APR just like that, and before you know it...very hard to even just make monthly payments.... I am now cutting back on everything I can to make life style changes to adjust my lifestyle on how I spend money. Only plan on getting a credit card in about a year from now and just use it for normal monthly bills to help establish my credit.

We once had money, being used to it got us into this after a harrassing law suit/s, but it took me 64yrs to believe what you just stated. SO you see, you are never too old to learn, and you are never too young to get "Wisdom" and teach. Congrats' to you. 'Hub
