    Another 60 Club Day Member Question?!?

    Our case was determined to be an asset case because the schlep trustee took our stimulus money.

    Last week we got a notice in the mail stating that the money was up for grabs by anyone who felt they had a claim to it, and that they had until September 2 to do so. The last date for blah, blah, blah....was October 2nd.

    Does this mean our discharge will be delayed until after the whole whoping $1800.00 gets disbursed? What happens to the money that doesn't get collected...if there is any left?

    I just hope not...we're trying like heck to get our lives back to normal.

    Any thoughts?

    The 60 day period is the period that creditors have to object to discharge-not, file a claim. These are 2 different issues.
    You should be discharged on schedule but, the trustee will delay closing the case until all assets are distributed.
    By the time the money is distributed plus, the trustee takes there cut, I'd not count on getting anything back.

      It will delay closing but not discharge.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        How long after the 341 did you get notice you are an "asset" case ?? Just wondering since I am expecting to see it any day now.

          Our 341 was on Feb. 7, 2008, the notice sent out to creditors notifying them that there might be a dividend available in our case came on March 10, 2008.

            We recieved the notice of distrubution about 30 days after our 341 hearing. Our case was changed to "Asset" about a week after our hearing. I found it on Pacer.

            That's good to know that our discharge won't be delayed. I don't care so much about the closing of it...just so i have the letter of discharge. They can take their money and ....well, you know the rest of the sentence.

              My discharge date is July 7th, TheBrokeCouple. I can't wait. My case changed to an asset case about a week after the 341 also. It's also good to know the asset status won't affect my discharge and so far so good. I also agree with where they can stick the Economic stimulus check, state income tax refund and money from the auction of the business equipment.

                I've been watching you too...I know we're going to get discharged around the same time. Maybe we can drink a cold one together...I know my hubby and I are going to celebrate once this is all behind us. We're SO ready to move on.

                  I hope you don't mind I have another question...Did everyone here who had the stimulus payment taken change to "asset" ????

                  Also hopefully I will be celebrating with you TheBrokeCouple and Southernbelle I can't wait to pop the champagne !! This is the LONGEST 60 days ever and I am still worried about being changed to an asset case this late in the 60 days.
