    Making an unnecessary purchase after filing?

    We are filing in almost 2 weeks now...after we file though, my lawyer said we need to bring in all the bank statements from the filing date until the 341 hearing. My question is, if we were to make a purchase for something that wasn't necessarily something that we needed, (not jewlery or luxury item) is that going to be questioned at the 341 hearing? We were told it would be about 5 weeks after we file that we'll get our hearing.

    I would be careful about buying anything that wasn't necessary.

    I just filed and I have to take my bank statement to my 341 next month. I am not buying anything I don't really need. I don't need to add more stuff for the UST to have a problem with.

        I don't know how fast it is in your area, but I just filed on the 5th of June and my 341 is first week of July.

          The lawyer said that in Vegas, it's about a 5 week wait after you file until your 341

            I agree you don't need to be making unnecessary purchases, but the trustee won't always ask for all documents that were originally requested. After the 341 though, you can most likely buy what you what without being questioned. I was afraid to go to McDonald's before my 341 for fear of being drilled about the $12 purchase!

              Between the 341 and the discharge is there any reason why you can't? If the filing already has happened, then the 341, why would a person not be able to make purchases? Trust me, we do not have extra money with kids ect. but if we decided to take them out for a fun day at the water park or a trip overnight, that's considered unnecessary, but if it's after the 341, why would they care?

                The trustee has total control over your estate until the discharge. Sure you can go on an overnight trip (hence why you are allowed an entertainment expense), but if you go an a 20 thousand dollar vacation and they look back and see that you could be in trouble! (and the kids are the reason you would need the vacation

                    Maybe you can spend on something nice, but not luxurious.

                      How often do they look at the bank statements? My husband and I put a security deposit down on a house that will be rent to own. Is that going to be a problem?

                        I am barely over the median it looks like. I went to a bar the other day and charged maybe 20 bucks of drinks and then took out 100 from ATM, one time I don't think will be a concern, but if I continue to do this once in a while before I file, will it be a problem?

                          I doubt it. We were told as long you don't have any major luxury or unnecessary purchases (particularly greater than $500), then you should be fine. Of course that may vary from district to district

                            For us, we can't spend on anything over 500. But we aren't spending loads on anything until after all is said and done.

                              When we went to our 341 meeting, we didn't have to bring our current bank statements. She just looked at our original ones that we filed with.

                              I, too, was also worried about going to McDonalds or out to eat, but they didn't even look at our statements.
