I am so freaked right now. Our 341 is in 2 hours and Im so nervous, Im trying to stay away from hubby. Hes one of those people who can forget about stuff completly and like, mow the lawn. I am worthless when Im stressed about something like this. Its all I can think about. 1 pm Eastern time send good vibes my way. We are over the median and haven't heard a thing yet from the trustee is probally why I am so nervous. I feel like today is the day the ax will fall. To top it off they came and picked up the truck last night. We hadn't driven it for 2 weeks I have been driving my daughter car. But now that school is out.....she would like her car. I am glad they came and got it. Its just a odd feeling. I dont know. Im rambling. I will go and make sure my ID and SS card are in the car AGAIN.

OK Here goes. It was bad but not bad in the way I thought it would be. Does that make sense? Right when we got to the lawyers office we were told by him that the US trustee was calling trying to get him to convert us to a 13. The US trustee knows that the judge we have does not like the means test and if you pass it you pass it, theres no puching with him. SO the US trustee was trying to get our lawyer to just switch us. The us trustee did say he would not object to the means test but that he might object to the "totallity of circumstances". Anyways then we head to the building the hearings are held. As soon as we get there the lawyer and our local trustee are off into a side room and the trustee let him know that the US trustee was asking a lot of questions and we would have more questions then the average 341. He was really bubby bubby with the trustee, that made me feel good it was like they were old friends. He had told us we got a good local trustee, that must be why. We were scheduled at 1pm and our lawyer was right up there "are we first" the secretary said "if you wnat to be " so we didn't get to watch anyone elses, we went first. When we sat down he also let us know we would have more questions then average. At that time there were only 2 other people in the room. At about the midway point like 15 other people came in. They were way to close to us is what I didn't like. I was already having trouble breathing and these people were so close they could practically read anything I had in my hand. The main questions he had that were unusual were about childcare. (we have someone come and stay with our 12 year old in the AM from 6:50 til 8am) its a neighbor and its only 4 days a week, hubbys home one day. Thats $40 a week. Odd question I thought. We live way out in the country and too many things were happening he was too scared home alone and if I took him to a daycare it would be alot more then $40 a week. They wanted to know about how long we had been paying on our 401k loan. Didnt understand why that mattered either. Anyways it was over before I knew it and we were on the way back to his office. I had asked him about a reaffirmation aggrement they had received so we went in to look at that. The the dear US trustee calls to talk to him about us. How weird. We sit there in his office and listen to him defend us to this guy in Cleveland. It was odd only being able to hear one side of the converstion. He doesn't like us in a 7 but in the end he said that he would set it aside and review it again in 3 weeks. I asked and was told that they have 30 days to file objections or what ever its called the US trutee would file. Does anyone know that for sure? I have read so many times on here that its 60 days. Anyways I would like to say Im in the 60 day club now but it doesn't feel right yet. I think we will have more bumps yet.
We are filing to void one of our mortgages. We had been told on here that you couldn't do that in a 7 but we just filed to do just that. Its only $10000 and its with the same company as our 2nd. Thats what I thought too. I even thought the paralegal was mistaken and even made a payment on it last month. Then today I was shown the letter he sent to the lender to "ask" about voiding the lien. He submitts this nice letter and see if they respond to it. I will let you know what else is involved as we progress.Filed Ch 7 - 04/08/2008 - Done
