If you are in a ch7 it will be taken from you, they will want it in a money order and probably the reciept as well where it was deposited, unless you can come up with a good excuse to keep it, and then you would need to re-hire the atty to amend the filing. thus costing you more than the check.

We filed April - had 341 in May. Trustee said nothing at the 341 to us or anyone else about the stimulus. Sure enough 2 weeks later we receive a motion to compel turnover of the stimulus. We are in NY and if you keep your home you have no exemption for ANY cash.

If in doubt don't spend it and speak with your attorney.

Spend it on non-luxury items and keep the receipts; you should be fine. In Ch7, it's what you have at the time you file, so if you file prior to receiving a tax refund or stimulus, they are considered part of the bk estate: you don't have to have actually received them to have them considered to be seizable assets. But if you have already received and spent them by the time you file, the most that will usually happen is that the trustee inquires as to what exactly you spent it on, hence the suggestion of keeping your receipts just in case you are asked.
