    What do I do if a Proof of Claim is wrong?

    I checked Pacer today and it shows I am still awaiting discharge...22 days, however, I was able to pull up the details of the Proof of Claim from the IRS and it shows that I owe for periods that my business was closed. It also shows that I didn't file for a couple of quarters when I did. Luckily I kept copies of EVERYTHING I sent to them.

    Since I have to deal with them after the Chapter 7, do I just wait and straighten it out then or do I contact the Insolvency Specialist who's number is listed at the bottom of the claim to get it straight now. My biggest concern is that they will charge me penalties and interest on taxes I don't owe and won't correct it later.

    Okay. Persistence paid off. I was able to track down the person in the Insolvency office and she was really nice. She told me to send everything to them now to make the corrections so that there is no chance my case will have to be reopened for some reason later. YIKES!!! That's incentive if I've ever heard it, so I'll be mailing her the info. she needs ASAP to make the needed corrections now to avoid any confusion in the future.

    Just thought I'd post this in hopes that it could help someone else.

      If I recall, you are doing a chapter 13, so in that case, the debtor should monitor the proofs of claims that get filed and object to any duplicates or any wrong entries. When it comes to chapter 7, it is not as important for the debtor to be concerned about proofs of claim so long as the debt is dischargeable. In a 7, you would only care about the accuracy of non-dischargeable debts that file POC's.
