    Domestic Support Obligations

    At our 341 we were told by the trustee to fill out a domestic support obligations form. My husband has custody of his daughter, however she lives with her mother and he does not have a child support order. When I look at this form, I see nothing that applies. Is there somebody who is familiar with this that can fill me on what information I need to provide to the trustee? If I called the trustee could he tell me what needs to go on this form or would that be considered "legal advice"?

    Can he show payments made to the mother or the daughter. Even if it's not ordered it will count if it's regular and he can show it. Who's taxes is she on? If she lives with her mother and he doesn't pay anything then it won't count as his expense. We had a similar situation with my step-son, not for BK now, but a few years ago for something else. We just showed the deposits made. Same thing though, my dh had legal custody, but he lived with his mom.

      We didn't claim the daughter as a member of the household nor do we show any expenses as far as child support goes. That's why I can't figure out why we need to fill out the Domestic Support Obligations form. Just making it more difficult I guess!

        Oh, I see, you don't want to claim a dollar amount. I would just put the fat zero then. They can't argue with that. It only free's up more cash to make payments with.
