    Garnishment refund question...

    My hubby and I filed on 5/23. Our lawyer called the garnishing lawyer to give the case number and since the lawyer was out and the paralegal wouldn't do anything, and since Hubby's payroll was set to be processed 8:00 am 5/27, we weren't able to stop the garnishment in time and his check on Friday will be light by 25%. Ugh.

    Our attorney says not to worry b/c we will get the money back "in a reasonable time."

    Anyone know what a reasonable time is?

    Depends on your Payroll. Mine stopped by the next cycle. I sent my payroll and the place that was garnishing me copies of the filing letter. Shouldn't be too long though

      Reasonable time means sooner or later, one of these days, or whenever they get around to it.
      That's my son's "religion" every time he should be mowing the lawn.

        Check with your attorney but I believe you can be refunded for any garnished wages prior to filing up to the amount of cash you can exempt in BK.

          update - check not garnished! How in the world...

          ... I don't know, but it didn't get garnished. The garnishing attorney was adamant that they wouldn't fax the dismissal to hubby's employer until Wed. morning. Guess the employer was able to adjust the payroll even though it was submitted Tues. am. WHEW!
