    Random exemption questions from 341

    So we had our 341 today. The trustee is taking the nonexempt portion of accrued wages($262)as of filing date, our stimulus check, the $107 we had in our checking account, and we need to buy back our tent trailer.

    Now, being a little creative, I had listed our trailer as exempt household goods. He told me that if I can give him a good reason to keep it that would work. This trailer is a 1973 and worth about $200. Does anybody know of a way to exempt it or will I be stuck paying for it?

    Also, as for our stimulus, we have 3 kids so we should be getting $2100 back. I would like to argue the fact that $900 of the stimulus is our kids' share and it should be exempt. Has anybody tried that and succeeded?

    Wow, they really took the 107? How low do you need to be for them to leave it alone? That's not even enough for grocery money. Can't help you on the stimulus question. We got ours last month and I'm not filing till next month. It all went to catch us up on student loans anyway, which is easy to show the bank transfer should it even come up.

      Tell him you'll surrender the trailer and he can come and get it. For $200 he's likely to just abandon it to you.
      Why on earth did you file before you got the stimulus check?

        Keepmine, it got us out of a ton more debt by filing when we did. The $2100 is just a drop in the bucket...still stinks though! I heard an attorney say he had been keeping all since the beginning of the year, so chances are he would have taken it anyway.

          That just makes no sense. You would have been discharged from that debt regardless of when you filed. You would have just gotten the chance to make use of the stimulus check.
          The only way they could have kept it is, if you filed before you received and spent it. The trustee has no control over your bk estate until you actually file.
