    Unfiled Taxes

    I am planning to file for bk c7 in the near future. I have a couple of concerns.
    1. I need to file 2006-2007 tax year to be current. Do I have to do that before I can file.
    2. DH and I never filed together, we actually filed HoH/Single different address? How will that play now if the trustee will be reviewing the tax docs knowing that we are married (for the last 8 years).
    3. DH has not file 2004-2007 tax year yet, is there anything I can do to "fix" our filing status now?
    4. I am not expecting us to owe anything, will any tax refunds received be handed to the trustee? Even if they are prior years?

    Just trying to prevent any mistakes while going through this process.

    On the paperwork from my attorney, it says you must have filed your tax returns for every year and provide proof for the past 4 years. I only had to have copies of 2006 and 2007. But if they ask for the others, I will have to provide proof that I did in fact file them.

        If you are filing alone then only you would need to get your taxes up to date....if you are both filing then you will both need to get them up to date.

        As far as your filing status on your taxes, I wouldn't really think that matters to the trustee....but that's just my guess.
