Do people claim tax refunds as incoem on means test?

Let's simplify this:
Please state whether you did, or did not include your tax refund (from filing, not the stimulus check) on your petition, and whther it was or not brought up during the course of your BK filing? (Wow- the responses on other threads are ALL over the board, but none of the questions is this clarified.)"Starting again is part of the plan"

My lawyer did not list it as income. It makes sense, because a tax refund is mostly a refund of money you have already earned and subsequently paid to the IRS. When they calculate your means test using your gross income, the money you have earned (which is possibly next years tax return) has already been accounted for. It would be like including a portion of LAST years income in the current calculations to count the tax refund as income.04/03/2008- Filed for BK CH7-Middle District of FL
