    Frustrated -Has this happened to anyone else?

    I filed for Chapter 7 Nov. 07 in Indiana , I've had my 341 Meeting and Trustee wanted my 2007 refund. I was told by my attorney's paralegal the amount the Trustee was taking and to get a certified check to them. I set up my tax refund to be direct deposited but received a letter from the IRS that it would be mailed. I kept in touch with my paralegal to let her know I had not received the refund. Then one day she calls me to say she has my share of the refund. Apparently the Trustee intercepted my refund - took his portion and cut a check for my share (EIC). I asked the paralegal why I wasn't notified he was intercepting it and she said "you signed the power of attorney".

    I was discharged in early March, but case held open for claims, ect. On Friday the Trustee sumbitted request for his fees to be paid and it was granted. (It was for the 25% of the refund he kept)

    I've asked my paralegal numerous times about the stimulus check and she thought I should be able to keep, since I filed before the stimulus law was signed. She only said "don't spend it - and let us know when you get it to be sure"

    I have received the notice from the IRS that I should receive my check by 5/16....but have yet to get it...

    So I am wondering ....is it possible that because my tax refund was intercepted, that the stimulus check also went to the Trustee???? I have tried to get in touch with paralegal so she could find out and she hasn't called me back.

    Has anyone else had their refund intercepted and their stimulus also? I would also think I would get some sort of notice from Trustee is he was taking the stimulus????

    I am aggravated with the whole thing just wondering if anyone else had same thing happen???

    Yes, I think my stimulus payment was intercepted.

    Mine was supposed to be deposited electronically on the 16th and it is missing. I checked the IRS website for the "Where's my stimulus check?" status and got the "no information is available" screen.

    There may be some hope though, because I read that if you used TurboTax and paid for your tax preparation fee through Santa Barbara Savings and Trust you would receive a paper check by mail. If I go by that time table, it shouldn't be mailed until 6/17.

      Yes the same thing happened to me.

      We did the same thing. Filed electronically and had the check direct deposited. We never got the direct deposit. We called the IRS number we were directed to when we checked our refund status online. The lady told us that they were mailing a check and that we should recieve it any day now. Well, I called my lawyer to let him know we were not recieving it since I knew that the trustee was waiting for her cut. Well he emailed me back a couple of days later and told me that the trustee had just let him know that she recieved the check. My lawyer put in a request for her to expediate the return of our exempt portion. She sent us a check in the mail that we got a few days later.

      Now this year, over a year after my discharge. I had some new issues with my income tax refund. However we were able to iron that out. We did get our stimulus check with no problem. But that may have been because I straightened things out with the return earlier in the year.

        I saw that post after I posted mine..what a nightmare!!

        I've tried calling the stimulus hotline hoping to get information on where they are mailing the check. I know it has not been the 6 weeks, but was hoping I could find out if it was intercepted, and have not been able to get a live person. So I am TRYING to be patient and wait on the paralegal to call me back. The trustee's office is across the street from me, and I really want to just go ask him, I know I can't...but would love to!
