    Panic question on gift income...

    I received a $5k gift from grandmother last Dec., and my bank statements show it being deposited on Dec 31st. However, I spent bits and pieces of it over the course of a few weeks in Jan (at the time it went towards CC bills). We are filing in July, so the 6-month look back is Jan 1st - Jun30. As long as the original deposit is dated in Dec., we won't have to include as income on our means, right?

    That's right. If the deposit shows in Dec 07 and you file after July 1, 2008, you don't have to include the gift as income on your Means Test.

      gift money to pay attorney?

      My father loaned us the $3000 for our BK attorney. I deposited it a few weeks ago and immediately wrote a check to the law office.

      Does his loan count as income then?? Or would I just list my father as a creditor and that money as a loan (which it was)? Does the loan status make it not income?

        You are correct. Now that means that your father will recieve notice of your BK and legally this debt will be discharged when your other debts get discharged. However, as has been mentioned numberous times on this board. There is nothing legally preventing you from paying anyone you choose to post bk.
