    New here 341 today

    I'm not really new here, but a lurker. I read these board everyday and have learned alot. Also have directed people here that are thinking of BK but need to get their research done.

    Hey everyone. We had our 341 today located in NV.
    Our time was 2pm we went in at 1pm to listen. The lawyer originally said the trustee we were assigned was "kind of a jerk" Well I can see why. At the 1pm meeting he had to make half the room, literally come back for another time.Mostly no social security card, one guy had submitted only one yrs tax return, one lady had almost nothing correct, another couple had paperwork the trustee needed a week ago and didn't get it in on time.These people had lawyers may I also mention. The trustee even commented to one debtor your lawyer is doing you people a diservice, the debtor replied I think it is my fault, the trustee said based on the last 4 clients she has represented, I'm positive sir it is her(the lawyer).


    At 2pm another lawyer representing our lawyer showed up we were 2nd on the docket. Previously my lawyer tried at the last second to scare me into a 13, well he had the means test messed up stating our gross per month was like 2k, it was more like 5200. So he ammended it but apparently when it went thru they did something and made it look like we were from Northern NV, not Southern NV so they had to re-file it for the correct jurasdicition. Lawyer tells me this on the way in. So the trustee basically hops right on the whole means test, after 10 minutes of us going back and forth I said you do have an ammended means test don't you.? He looked at me puzzled, then at his computer for a minute and says oh yeah ok this makes sense now further questions. Total time with the trustee 20 minutes.

    He stated to everyone in the room before bringing anyone up. We are going to have a meeting, when you are done if nothing else is needed, I will let you know that at the end of your individual meeting then wait 60 days for your d/c papers. Make sure if anyone moves in the meantime they notify their lawyer or the courts so we send it to the right place. So I guess we are done and now the wait.

    Just wanted to share my expeirence. A big thanks to everyone here
    The Trustee did not mention our stimulus which is going to be a paper check due around June 20th, so I'm not mentioing it either. LOL well see if any paper comes thru the mail requesting it. We are expecting 1200.

    thank you for sharing your experience!!! i'm definitely not as scared or stressed after reading stories like yours. this will be doable.

      Yep, always good to hear these. Thanks for sharing! It got me thinking, though, about what bad luck it would be to have an attorney that a trustee thinks is a screw-up. I would think that would make the trustee inclined to look that much harder at the debtor's file.
      04/04/08- Notice of deficiency balance due from a repo. 04/18/08- Fico scores w/repo listed: EXP 624, TRAN 610, EQU 610. 04/19/08- Found this forum. 04/24/08- Retained attorney for a chapter 7, filing singly. 5/5/08- Turned in bk paperwork to atty. 5/27/08- Date set for reviewing paperwork.

          We are filing in Las Vegas also....who was your trustee if you don't mind me asking?

            It was Leonard (last name). Ask away. My attorney don't know if I can say the name or not so he has commercials on tv that has a guy in a wheelbarrel thingy, and says if an attorney tells you to file chapter 7 get a second opinion.LOL He really did all the paperwork.

              I must have gotten a good one. The trustee I had was very professional and quiet spoken. He asked...folks answered...end of story. I guess it's all luck of the draw, good or bad.

              It still amazes me to read horror stories of people that pay lawyers to do a job and have it all dorked up. There's absolutely no reason to be unprepared if the lawyers are doing their jobs. It's too bad there isn't some sort of matrix that's made available to weed out the less than desirable lawyers.

                Yeah jp2861 I bet you had Cory right? I heard he was ok. He seemed more mild mannered, when he was calling his group in.
                As far as the lawyers I interviewed 4 of them and it seemed to me the more you understood the process the more p/o'd they were with you. I reasearched all I could before I ever set foot in a lawyers office. Thanks to these boards and just went with the one I did because they really did all the paperwork from what others say they had to fill out. Of course I still reviewed each one for accuracy. and the price was 1300 total so not bad, that was about the lowest I found.

                  I'm in Las Vegas too. My attorney does a radio show at 1100 am on Saturday mornings on 720. He seemed to wait a lot more documents then what I see most poeple posting here required. I believe that it is so he can imediately hand them over if aduited. Examples: 4 years tax returns, 6 months of all bank statements, copy of DL/soc sec card, 6 months pay stubs, business records, ect... It's hard to believe that he won't be prepared at the 341 meeting. I'm glad he wanted everything up front. Saves me the worry of trying to find things at the last minute before the meeting.

                    ThisCantGoOn- we have the same lawyer! He was NOT at my 341, another lawyer or paralegal not sure was. Yes he does require more but we had no request for any other documents so that is a good thing. Check your means test money wise and make sure they are correct. I had to go over this several times with them and apparently at the 341 I had to explain to the trustee they had made a mistake, and to make sure he was looking at the ammended means test.The trustee did ask some people what they spent their tax refunds on, but mentioned nothing of the stimulus, to anyone.                       Me & wife are doing chap 13 also in Vegas, with the guy on the radio!! Just paid retainer Monday. We have 110k in credit cards and make to much for Chap 7. Hopefully we can pay the rest soon and get going..
