    Motion of "abuse" to be filed by UST?????

    me again. I just found out from my BK attny that if I don't get them the following info, the UST will file a motion of "abuse" on Friday!!! What does that mean????? What can happen? I'm freaking out, but I will be moving forward and staying strong.

    What kind of information are they asking for? Was the US trustee present at your 341 meeting?

      Nothing to freak out about yet. The trustee is going through the motions, I suspect that you are over the median income, correct? Thus, the US trustee at least has to look at the case and sign-off...which usually will require additional documentation.

        HHM, you are very much correct... we are over the median income (even with divorce/two households(?). Amazing since me and stbx-h are on the brink of loosing our shelter? I actually thought just the opposite. I thought we showed to have such little income they wondered how we *really* survived! LOL... as tho we were hiding income & getting paid under the table somewhere and being gifted money!

        Anyhow, I think your right, and so does my attny... UST is going through the motions and now, we just wait and see (and pray) I got ALL the paper work together, the $675 to pay the attny and turned in. Just last week I thought I would flop forever, and I found the fight in me again. That felt really good.

            Ok, if they were to ask for this, how do you come up with statements that far back? We don't have them dating that far back.

              you can call your bank and ask for them. if you let them know it is for a legal matter they often won't charge you.

                My step dad taught me to keep all statments for like three years. I had 89% of the statements they requested. My attny said that ppl who don't have the statements, request it of the cc companies but it is *really* hard to get, so then my attny sends the trustee that they attmpt'd to get the statements, but couldn't. Luckily, my step dad taught me well. He's a *wonderful* man! All the documents together, were about 3-4 inches thick, but I got it done.

                  Good to hear you got it, this looks like a standard UST thing, I still think your in pretty good shape.
                  May 31st, 2007: Petition Filed by my lawyer
                  July 2nd, 2007: 341 Meeting Held
                  September 4th, 2007: Discharged and Closed.
