    Most BK attorneys will represent you and/or answer questions about anything pertaining to your BK, even after your case is discharged, so try that route first. Next, making a threat such as this is against the Debt Collections Act and you could have a good case against them for threatening/lying/or whatever........but.......go with your BK attorney first. He/She will be able to take care of this for you.

      Yep go to your attorney....believe me if these folks are disobeying the stay he'll be interested as it can mean a payday for you and him. Make sure to keep all documentation for your lawyer....I think its per contact...the fines if he has to pursue it. Most folks are smart and stop doing it once the attorney contacts them.

          follow up with certified letters to the trustee in your bk case and to your attorney. Keep copies of the letters and the receipts. Then write a letter to these jerks, also certified and let them know that you are going to sue them 1000 for every phone call. If it doesn't stop, then file a claim in your county court (small claims) and have your receipts as proof. Also record the messages and don't throw away the tapes.

            Oh lordy, not those jerks! They tried to do the same thing to me --> collecting on a pay day loan that was done before we filed BK back in June 2005. I told them that all my debts were forgiven through ch7 and the "investigators" argued that my debt could not be forgiven and that I was about to be arrested. Welp, they started calling like 2.5 months ago and I'm still enjoying life as a free woman. When the last "investigator" called I told him I was still waiting to be arrested and for them to hurry up because I really had to pee. That was a month ago.

            Next time they call, tell them to bring it on. Tell them you'll make it easy for them and meet them at your police station or county jail (although, this might not be a good idea if you *really* have a warrant out for your arrest ). Play with these *******s. Offer to give them the police or sheriff's phone number, or tell them to call your lawyer and give them the Po-po's number instead.

            All joking aside, these are scumbag debt collectors who purchased alot of useless paper. This bank they are talking about no longer exists, hasn't existed since the mid 90's I believe. Google the phone number and see what you find.

            As far as suing these jerks, most of the time they will not give you an address. All they are interested in is getting your bank account information. Try asking them for a genuine address.

                This is a scam. These guys are criminals. They are likely operating from offshore, since the FBI would like to catch them. They are like the Nigerian check scammers, except worse.

                      these can be fun sometimes but can be a real pain too especially when they keep on bugging you. anyway, don't fall into their traps. it's all a scam!

                        Try to get as much info on them as possible so you can a) file a complaint for money from them for harrassing you after discharge and b) so you can report them to the FBI.

                        Try to get them to give out info on where they are operating - get a number at which you can call them back, get an address to "send money to", ask them for their corporate headquarters address,etc. etc... If nothing else you can make them nervous by asking all these questions.

                            I would report them because the above posters have given you some really great info. If they are calling you on your home phone or cell, use caller id and just ignore them. Work is another subject though.

                              HEY GUYS, as you well know, you are getting all kinds of credit offers now. These scam artists milk, and bilk the Public Records for people like us. If you are computer active (I assume you are, being here) you know how many scams to correct your locked up accounts there are, just give them your bank numbers and first born.

                              Clark Howard has talked often of this, and there is no real reason to be concerned. I think there is a way to block a specific number on your phone. I don't remember the code but check. If they truly are for real, and that would be doubtful, they are breaking the law. You are only obligated now for current debt or debt you accepted to pay in the bk. I am sure of this. If I am wrong I stand to be corrected as if I weren't wrong before, I would not be here. LOL REAL GOOD THREAD.
