Getting Kind of Nervous

Hi everybody!

Our 341 meeting is on Tuesday at 3:30pm. I hadn't been nervous until today.

I couldn't stand it anymore and looked us up on Pacer.

It says we are a no asset case. There is a name of the US State Trustee on our file as well as the local trustee as well.

Just wondering if it makes a difference that her name is on there too?

I guess since it says no asset, and our other statement that was mailed to us...the notice of filing said there was no evidence of abuse, then it's likely we're okay.

I'll be so glad when Tuesday is over.

Just quick answers, yes/no...don't say more than asked.

We did spend our tax refund, but our attorney said to be ready to tell the judge what we spent it on. New apartment (rent/deposit), utility bills, food, clothing for the kids, attorney fees, new bed, washer and dryer for new apartment. *** sigh ***

Anyway...say a little prayer for us.

Just keep in mind your not the only one at that upcoming 341 meeting that are just as nervous as you maybe even worst! It'll be over before you know. Just don't tell what they don't ask!

Remember to bring you ID ! Recent tax papers, recent bank statements, recent paystubs. Even though your lawyer (if you had one) should already have them submitted to the Trustee, you never know what could me missed. I was missing my 2005 tax forms and the Lawyer forgot to give them to the Trustee, luckily I had backup!

You will be fine. Just say yes-no on 95% of the questions and be honest about the $$$ you spent.
Sometimes US Trustee's just add themselves to a case and nothing ever happens. There is usually a US Trustee poking around regardless - and being you are a no asset, that helps a ton. I had a US Trustee on my case and they never said boo.
Good luck and make sure you post the type of questions you were asked. It helps a lot!!

what is 341... is it aka court hearing for bk filing?
you guys, what is 341?

anyhow, i got discharged in feb. and did tax return in april... got a refund... i guess im ok to keep it, right?

another question, if bk is discharged, means everything i listed is, right?
can the decision be reversed or motioned after formal discharge? what can do that?
