    new here, need advice

    hello everyone i am in need of some advice,
    i live in ky
    i am recently divorced and give my ex 185 dollars a week in support payments,
    i have a 18 thousand dollar vehicle loan and credit card debts of nearly 16 thousand dollars,
    i earn after tax and insurance etc about 400 dollars a week, i have to pay my rent support and expences out of this and i am having a hard time making my payments,
    do you think i will be eligible for chapter 7?,
    PS i understand that i must continue the support payments
    i thank you in advance for any advice you can give me

    hi, welcome - i'm not the best with math, especially someone else's ;). and i'm definitely no expert on BK, but here's what i do know:

    the most simple way to consider if you qualify for chapter 7 is you need to make less than the median income for your state, and have $100 or less in disposable income a month. if those two things are true it's a no brainer. there are other factors that can come into play too; for $29 you can pick up the NOLO Chapter 7 Bankruptcy book which has a lot of great info in it as well as some worksheets and form samples.

      Welcome. As Soleprop says, the Nolo Chapter 7 Bankruptcy book is one of the best investments you can make. I wish we had known of it before we started investigating BK in 2006. It would have saved us a lot of grief that we are going through right now. This forum is also a God-send.

      If you can go online and buy it from nolo.com, the print form is $19.99 plus S & H. The ebook version ( in PDF format ) is $17.99 and does not take very long to download. The only problem with the ebook version is that if you want to carry it around with you, you will have to print out at least the parts you are referring to at the time--which is somewhat at odds with the concept of ebooks being 'green' and saving trees.....

      Find out how bankruptcy works, what bankruptcy can do, the differences between Chapter 7 and Chapter 13 bankruptcy, and if you should declare bankruptcy.


      BTW, NOLO offers a free guide along with any purchase. Be sure you take that as well.
