    I filed today!!!!

    Yay!!! I finally did it. I signed the paperwork today and they officially filed my Chapter 7. I combed over that paperwork with a fine tooth comb and found a couple of small mistakes, but the girl who prepared my paperwork was awesome!!!

    A few facts:
    -My house is protected by exemptions (believe it or not the liens actually helped me to keep my house...go figure)
    -My schedule I showed $1503.73 take home ($4478.93 gross wages)
    -My schedule J showed a net of $168.20 (that feels about right)

    When I walked out of that office I wanted to scream. I felt a tremendous weight lifted off my shoulders. I can only imagine what it feels like to actually get my discharge.

    This was filed as a chapter 7 with mostly non-consumer debts and my atty. said the addl money I'm contributing to my retirement shouldn't be a problem because he's done this a bunch before. He did say that at my 341, I should expect to be grilled about the business stuff not how much is going towards retirement because it's a business chapter 7, but not to worry because he said I look VERY prepared. I have all of my stuff in a rolling dolly with tabs and binders and everything. If the Trustee asks for it, I've got it.

    I also feel 100% better about giving my atty. those tables. He listed it under the section where he indicated how much I paid him. Seemed on the up and up to me.

    The only other thing they told me was to not spend a ton of money on a new plasma t.v. or anything like that. I told them not to worry because I don't have the money anyway. This was all perfect timing because my account is actually negative $30. WOW I feel good today.

    I'll be holding my breath until I get the notice telling me when my 341 is and what paperwork to bring to it.

            Woohoo, SB - way to go! All the prep really paid off with great peace of mind. Now it's just wait out the days to your 341 then to discharge. You're on your way!

              Congratulations! I'm glad everything seems to have worked out for you, that your attorney doesn't think your contributions will be a problem, and that he (sounds like) listed your table sale correctly.

              I'm not sure what you meant by "This was all perfect timing because my account is actually negative $30."

              I'm not sure whether you meant you wouldn't have to pay it back since it was owed before the bankruptcy was filed. Although true, I would recommend paying it back to avoid being entered into any bad check / bank account systems or having your bank relationship ending. Although they couldn't try to collect the debt, I'm not sure if TeleCheck/ChexSystems/etc has to remove the account from their database when someone files bankruptcy, to allow you to open up future bank accounts. I had about $80 to TeleCheck, and couldn't find out if I would be clear after filing, so I wound up just paying them to clean up my file with them.

              Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

                Hmmm, Phoenix...I am going to be filing on an overdrawn checking account of only 49.00. This is only due to fees that were incurred due to another creditor repeatedly trying to draw money out that they were told they had no authority to do so. My lawyer told me not to worry about it and I did read on this board that you can call Telechex once you are in BK and they will remove it. (we'll see)

                I knew this was going to happen even before the account was overdrawn, and since I had two loans with this credit union, I ran out and opened another checking account while I still could.

                Besides, I don't think you can pay anything you BK's on until your discharge, and then why would you want to?

                But I digress...This is ALL ABOUT SOUTHERNBELLE and I repeat WHOOOOOOOOOHOOOOOOOOOOO!

                    Congrads!!!! I thought getting the stuff to the attorney and filed was the best feeling in the world.

                    phoenyx: I think she meant that she was negative in her bank account, so there was no cash to exempt.

                      Yeah. My bank acct. was in the negative because a check I didn't expect hit my acct. and I don't have any exemptions for cash so that means the Trustee has nothing in my acct. to go after. My regular paycheck hit today so I'm back in the black, but I just didn't want my whole paycheck sitting there for the Trustee to go after.

                      I'm soooooo relieved!!!!!

                        It's entirely possible that TeleChex might easily remove it once you are in bankruptcy. I couldn't find out for sure, so decided to pay on my account since it was so small to avoid the issue completely. It's entirely possible I may have paid the account for no reason, but did it on my attorney's advice since it was relatively a small amount.

                        You can make payments toward things before your discharge, but generally there's no point. This is sometimes done when someone wants to keep an asset that they are paying toward, like a home, car, or other secured property. Sometimes the person you are paying might not take the payment, and ask for it after your discharge. I paid TeleChex before I actually filed, so this issue didn't come up for me. The reason why I paid on it is that I don't have a bank account right now, and preferred not to open one before I filed, so I didn't want to have a hard time in the future opening one.

                              congrats, Southernbelle! And yes, Chexsytems is VERY VERY easy to deal with! As soon as you get your discharge, just request your chexsystems report from the 800# on the webside. Simply fax them the dispute form and your discharge paper and they will have the acct removed in less than a week.

                              I didn't believe it myself, but it was that easy!!!!
