    Can ch.7 stop a bank levy

    Hi I'm new to the forum I had bank levy on my account for 10K for a judgement for chase credit card, I filed a exemption and the money is still in possesion of the court. I did get a new court hearing for may,my question is it possible to do Ch 7 and still get money back or go to court and see what happens. Thanks

    A bk filing will halt all collection activity-that includes lawsuits.
    The money would be returned to you but, depending on the amount involved it may be above what your state exempts and become property of the bk estate.
    From the info you give, it's not possible to advise one way or the other on bk.

      thanks for the reply, I'm in california so don't know what is the amount i can exempt. Some attorneys that i have talked to say that doing a CH.7 like you said will stop all collection activity but getting money would be a different story i think one said i also needed to file a motion to vacate after i do the CH.7. I'm really unsure as what to do i'm already down 10k

        I had my wages garnished and filed ch 7 and it halted the garnishment. But I did not get already taken money back. I assume it would be the same with the bank levy but I'm not positive. I would file though tto prevent others from doing the same and to keep chase at bay.
