    Judgement hearing.

    Hello Ive been in the process of getting a bk attorney the last couple days and hope to speak to one in person next week sometime. The thing that has me worried is yesterday I recieved a summons to appear in court for the hearing of wages being garnished. Apparently we missed the first hearing where the judge awarded it. This summons we got is to see how much they get I guess.

    What I was wondering is about how much they can get from our checks and the court date is set 4 months away so would I have enough time to start the bakruptcy to prevent them from getting anything.

    Me and my wife make very little income. We have a family of 3 and our income for last year was under $15000. I plan to show evidence of this and show evidence of our bills to show we cant spare another nickel. What I'm worried is about is if they don't care about our hardships and tell us to get 2 jobs if we have to.

    I will be speaking to a attorney next week hopefully, but if I could get a little info now it would give me and my wife a peace of mind until we speak to a paid professional.

    Income is about $1400 per month. After rent, utilitys, diapers and food we are left with hardly anything at the end.

    Since the court date is 4 months away, you have time to file bk and stop the garnishment.

    No matter what state you live in, this income will qualify you for a Ch 7 filing.

    That won't happen - don't worry. All the court cares about is what is on your bankruptcy forms. The trustee doesn't care why you got into debt - all that matters is how your income compares to your expenses and whether your assets can be protected by your state's exemptions when you file.

    You are the family that bankruptcy exists for, michael. As long as you have sufficient income after the bankruptcy to support yourselves, you'll be fine.
