    Motion for Dismissal

    Anyone have a downloadable or know were I can get a form for a motion for dismissal that I can submit to the local court.

    Or anyone know the format.

    The motion is for a filed case by a creditor. I have 2 weeks before the court date.

    I wanted to file it the day before the case. The creditor/atternory's office is over two half hours away . So I thought I would let him make the 5 hour round trip.

    These guys were mean.

    I'm confused. What happened, exactly? What did one of your creditors file? When I first read your post, it sounded like a creditor(s) is pursuing an involuntary bankruptcy for you.

    But, previous posts of yours look like you were voluntarily filing bankruptcy and filed your own petition on March 31.

    What is it that you're trying to dismiss? "Motion for dismissal" threw me off, thinking you were trying to make a motion to dismiss the bankruptcy.

    Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

      Yes I 'm going the BK route, i filed myself. The motion is for a local case that has been filed by an attorney on behalf of DELL, one of my creditors. I was looking for a form that I could fill in and give to the local court to dismiss the case due to the BK that I filed. I know that the case will fall under the federal stay law, but I wanted to see If I could get it dissmissed. I don't know if this is the right approach or even wordage

        Just respond by stating the date you filed bk and, give the filing number and ask the court dismiss the case during the pendancy of the bk.
