    Motion for Relief from Stay

    Hi all - I keep checking pacer and only so far only 1 of my mortgage companies filed a Motion for Relief from Stay. I am surrendering the properties. We are 2 months since I filed and a little over a month before my hopeful discharge.

    My questions:

    Should I be concerned?
    Do they all have to file a Motion for Relief from Stay before my case can be dismissed?
    Should I call the mortgage companies at this point and just tell them that I want to surrender the properties.

    The morgage companies are still sending me mortgage statements and notices like they don't know I am in BK. One even called me the other day and said that didn't have it on file. Huh??

    my mortgage company didn't file the relief until about a week after the 341. Don't worry, when they feel the need they will pursue. It won't hold up your Ch 7 at all.

      Did you give them your bankruptcy number, chapter filed and court filed in. If so that should take care of that one.

      If you filed with a lawyer I'd mention to the lawyer about the situation of the contact and make sure they were listed on the creditors matrix.

      The one that has filed a motion to lift the stay is in the process of getting the property I'm sure. They have to file that to be able to take possession.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        Yes I will talk to my lawyer about it. Maybe they sent it to the wrong address. How soon can they take the property after the Motion hearing? Just

          Depends on the laws in your area. However since you are surrendering it as part of the BK it should go fairly quickly no more than a month or two I'd think.
