I have finished my 341 meeting and the day after the trustee did the notice of no asset filing.
When do they start asking for more docs?
If your trustee has declared that you are a no-asset Chapter 7, unless the US trustee or a creditor objects, then you probably won't have to produce any other documents.
If you filed with a lawyer, does he/she think you may have other issues?
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
06/01/06 - Filed Ch 13
06/28/06 - 341 Meeting
07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
08/10/11 - DISCHARGED ! 10/02/11 - CASE CLOSED Countdown: 60 months paid, 0 months to go
See, some are different as that "currently" isn't the case with me.
I was declared a No Asset case on 3/17/08 and on 3/20/08 the paralegal for the US Trustee is asking for my wife's income vs debt. I filed seperate so I can indeed understand why they would ask for this info. Most likely want to verify my wife is not using dollar bills as kindling wood to start the fire
Some of their questions are like this:
1. Please show your wife's expenses that ARE NOT part of the household.
2. Please provide recent statements of these debts (i.e. Sprint cell, doctor bills, auto loan, student loan, etc..)
gophermn - I filed separate too and noticed my husbands income is not on schedule J - should I bother the attorney to put it on? I think it's supposed to be on there.
I hope I don't get those questions. It sounds confusing to me.
When everyone says the trustee has declared or filed you a no asset case after your 341 - how did you know that? I have been checking pacer daily since our 341 2 weeks ago and nothing new is there except the notice saying the 341 was held and concluded - at the mtg he asked for info on property we hold - we sent it the next day. Just wondering - if we are declared no asset would that show up on Pacer right away? Thanks - we are on pins and needles!
For me, a "notice of no asset" showed up the next day. That is my question too...does that mean it has already been declared or does it mean they are looking into it since it says "notice"???
Filed 2/15/08
341 held 3/18/08
Notice of no asset 3/19/08
UST requesting my paystubs post 341? 4/21/08
Blaze, it can take several days, even a few weeks, for the trustee to update PACER. Thank God most of them seem to do so quickly, but I have heard the rare report of waiting for several weeks to get a No Asset determination posted on PACER. So it will show up soon, perhaps not right away, but soon.
Specifically, what you will see is not a document but an entry that looks something like this:
"Meeting of Creditors Held and Concluded on 3/27/2008. Trustee's Report of No Distribution: The trustee appointed in this case declares under penalty of perjury that the trustee has neither received any property nor paid any money on account of this estate except exempt property; has made diligent inquiry into the financial affairs of the debtor(s) and the location of property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to FRBP 5009, the trustee certifies that the estate has been fully administered, and therefore requests that he/she be discharged from any further duties. (Sally Trustee) (Entered: 03/28/2008)"
Hope this helps.
Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!
Thanks fresh- so far we just have an entry of mtg held and concluded. hopefully we'll see something else soon - but I am afraid we may have an issue with some property - if so I just wish he'd let us know so we'll figure out what to do - I have heard you can buy out the equity by paying the trustee for your share-it is property my mom in law owns but she had put hubbies name on the deed at some point so we had to tlist it-- anyway - I'll keep watching...
tommy - to me it sounds like that means the trustee has declared your case to truly be a no asset case so you'll just have to wait for your discharge I guess - I have heard of many cases being declared the day after - I hope so for you anyway! Good luck
