How many times do I have to go to court for my BK7?

Just received a letter from my lawyer and is says in the letter "my first meeting of the creditors is scheduled on...."

Sounds to me like there is more than 1 meeting? I guess I thought there was only 1 meeting.

What do I bring to the 341 - All they asked for so far was social security, and drivers license. Do I need to bring anything more than what they ask for? (although in the last few weeks they asked for a few documents/records)

Anyone with any experience on this matter,

You will go to the 341, you have to be there.

Assuming no glitches that is all you'll have to attend.

For the 341

1. Bring Driver's License (or other government issued ID card) and Social Security Card. (Used for Identity Purposes)
2. BE ON TIME (This is super important, its actually better to be a little early)
3. Do Not Bring Children
4. Dress as you would for a restaurant visit. (Not necessarily your Sunday Best, and certainly don't go buy a new suit for it).
5. Do Not Wear Expensive Jewelry (plain earrings if you must, plain wedding band, nothing else)
6. Do Not Bring a Cellphone
7. Do Not Bring Electronic Devices.

What are they actually doing there? If they decide a CH7 is not for us, do they decide a CH13 right on the spot?

Techno, JR hooked you up there with the perfect info. 341s are usually only held once per debtor, but many debtors have several. So yours is the First Meeting of Creditors. Quite possibly the last.

Since I was pro se, I took along some extras: a copy of my filing in its entirety, a copy of everything I had sent to the trustee, and the copies of all the prints I made from Ebay when I was valuing all my stuff, just in case he asked where I got my value for things. I didn't need it, but had he started asking me detailed questions it would have been the perfect set of documents.

Biggest thing: don't forget your ID and Social Security Card. Forget those, and the meeting goes no further.

FreshLikeDaisy, when you say "copy of everything I had sent to trustee" what do you mean by that ? I have sent nothing to my trustee, my attorney has all my paperwork. I do have copy of filing report though. My attorney as well told me just to bring SS/ID. Besides my copy of filing, I wouldn't know what else to take with me...?

Thanks for your info! I really appreciate it! After talking to several people it seems most 341's only last 5 minutes at most.....I imagined myself in this huge courthouse being prosecuted with questions for hours while their is a jury looking at me with disdain....

And congrats on your discharge!!!! IT MUST FEEL GOOD!!!!!!
Did you feel any relief after your 341?

Was the waiting period pretty hard on you between the 341 and discharge?

For me (YMMV, of course) the worst was prior to and just after filing; then just before the 341, and that was pretty much it. I missed my discharge & closure, I was so relaxed! No, I didn't have any worries between the 341 and discharge, mainly because I only had one or two creditors that could possibly have objected, and it had become clear to me early on that they probably would not, they just didn't have standing. And neither did.

Now, MidwestGuy, you're going with an atty to help and guide you; I wasn't which is why I brought all that extra stuff. I don't think that'll be an issue for you. But I **DO** highly recommend that you look up your own filing in PACER and review each page carefully, making sure the numbers are in the right spots and that they are accurate. Just that quick post-filing check has saved many folks here a world of pain, because they were able to spot mistakes in time to figure out what to do and how to handle it... some, right on the eve of the 341. Talk about a scramble!! So save yourself some time by looking over your petition now. Bringing a copy to your 341 wouldn't hurt, either. Good luck!!!

I noticed that you do HIGHLY recommend PACER - I have an attorney and have a 341 tomm.....

I do have a paper copy of all my bankruptcy paperwork (probably about 50 pages long at most) that I received from my lawyer.....

Will PACER just show me what's been filed (a copy of what I already have)???

Should I try it?
