    Renting Post BK7 >>>>>>>>

    When i file BK7, I know im going to have a hard time renting. If i get a place before BK7 (Walking away from home) Will i have to add them to my BK when i file?

    We just did this. We were upfront with the property manager about walking away from our home, filing BK, and the need to rent an apartment. She said "Lets get your credit pulled before it's trashed." We did have to list them in our petition as it was a contract we had signed within 1 year of filing.

    I know they were notified. I've talked with the woman a few times about various things and she hasn't mentioned it.

      Im going to go try for an apartment this tuesday. I told her about my credit being pretty low, Divorce, ect... and she said i would have to pay a higher deposit. But she did say, "No BK" So if i let them in on what might happen in the future im pretty sure they are going to not let it happen. So, Should i stay quiet? Can they evict me or something down the road when i do file?

        I'm confused. Why would you have to list an apartment in your BK unless you were in arrears to your landlord? Wouldn't your apartment just be treated as an expense and not a debt? Is it because you had a lease?

        Was your landlord notified of your BK?

              Trouble...according to what Divia just posted, if you have to sign a lease for the apartment, you will have to list them on the schedule but they will not be included among the BK creditors (unless you include them and why would you?) and they will not be notified.

              With that information, were I you, I would not tell your prospective landlord about your upcoming BK. Every question regarding BK that I have ever seen on a contract, asks if you have ever filed BK, not if you intend to file BK. It is unlikely that your landlord will ever pull your credit again after the initial tap, assuming you stay current on your rent.

                  The management company's mailing address was included on the address label matrix... I just assumed that they would be notified.

                    Sharksfan, you hit the nail on the head. If you include someone as a creditor on your matrix, they will be notified. Whether they have to be or not. Just because you included them on your matrix.

                    But in actuality, while you DO have to disclose the lease itself in your expenses as well as on Schedule G, you DON'T have to include them anywhere else, including the matrix, and they DON'T have to be notified if you're current and not trying to discharge any additional debt with them. So yours got notified, but probably didn't have to be. I think it was good you were upfront and honest with them, though; that's always best. I keep hearing that people are having unexpectedly good results with being upfront to landlords about bk and possible bk, especially smaller, non-commercial landlords. There are a lot of people trying to save houses right now, many by renting them out.

                    TroubleInCalif, I'm hoping that if you can't get a deal at the complex you're interested in now that it won't dissuade you from looking to rent from smaller landlords; I think you'll be unexpectedly surprised. I have a friend whose personal credit is worse than Enron's, but who had no problem renting a really nice house. That's just the way the market is right now, so I think you'll have no trouble getting into a place. Good luck!!!

                      The prices for renting houses here is kinda high. The house across from me that did a short sale got bought by an envestment company and the rent was 1500 bucks! Ouch! Plus i had a friend of mine rent a house that within 3 months was gone to forcloser and he lost his money... Kinda scary around here. The main reason for me is because its just myself and my youngest daughter who will 18 next month so an apartment is just our size.

                        Hiya Flad. Well this is a first, but I actually disagree with you.

                        I do not condone dishonesty but if Trouble's intentions and capabilities are to pay the rent on time, then I don't see the harm in not telling them about the intent to BK unless they actually ask if he is going to BK in the future, which IMO is unlikely. If Trouble is going to live up to that obligation, I don't think it's any of their business.

                        And I don't know where Trouble is in California, but where I am, and it is pretty much the same all over this state, it is a real ***** to find, qualify for, and afford an apartment. And a house? Forget about it. If you have to BK, you can't afford to rent a house here. I don't know if Trouble has pets, but if so, that throws another huge obstacle into the mess.

                          Actually, I don't disagree. I do not believe TroubleInCalif is being dishonest by not revealing a potential bk, not at all. I was actually addressing Sharksfan and not realizing it would contrast with what you had said as though I disagreed. Nope, you're right: they'll probably do a one-time credit pull and then that's the end of that. But she might want to look over her lease very carefully before signing it, just to make sure there's no bankruptcy clause in it.

                          I see your point about California too; I was speaking of the East Coast but I didn't realize it was that hard to rent out there where you are. That's harsh. Is it that bad even for a little duplex or something? Uggh! No wonder she's concerned!

                          Ah well, my apologies for creating confusion. But I am rarely as sweetly corrected as I am on this board. Feel free to disagree anytime!

Absolutly, Of course i want to pay the rent, Im not willing to get into a position that may put me on the street or motel 6 paying 50 bucks a night when im done with the house.

                            My daughter has 1 cat and this place is pet friendly, so no problem there. But one of the first things she said when i talked to her about renting from them was "NO BK!" 0, Nada, Bad Bad Bad! So there is noway im going to say something if i dont need too. Not trying to be dishonest, Just surviving is all.....
