    FED-EX Door Tag

    After 11 months of collection calls (on my credit cards), I received a Fed-Ex door tag- what can this be? Wouldn't I get a certified piece of mail if it was some kind of subpoena/litigation?

    Not necessarily. It doesn't hurt anything to claim it, though, so you might as well have a look. Good luck!!

      Who knows.

      But as has already been stated, you can't make things worse by claiming it. For any sort of legal stuff, generally, the requirement is that it was "sent", not that it was received.

        it originated from Marietta,GA, so its probably Mann-Bracken sending an arbitration notice. It was sent 3/13/08. What do I do now- how do I delay this process? They'll give me 30 days to respond- i'll be out of town the 13th-15th of April.

          If you have your door tag handy, call 800-GO-FEDEX and they can tell you who shipped it. They will also be able to tell you how many times they will attempt delivering the shipment to you, and how long it will sit at your local FedEx facility for you to pick it up before they return it to the sender.

          Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

            Mann-Bracken is a firm that processes arbitration and all that. If you don't respond they will likely just get a ruling in their favor and then secure a judgement. The credit agreements often have an arbtration section in the fine print. Meaning, they don't have to take you to court and can get a third party to say that you were in the wrong.

            They are right down the road from where I work. They've been calling and leaving messages but never any details. They don't know I've filled yet... and I hear they do a lot of harassment, etc... even if you've filed, they repeatedly violate the stay.

              if I send a cease-and-desist letter will it at least delay the arbitration? that is what i want- i don't deny the debt..if i send it return receipt, and I know they sign it- do I just wait for another arb notice- or what happens?

                i wouldn't imagine it would delay it... nor would they cease or desist. You could argue the debt isn't yours and that could stall them. You could try to work with them to reach an agreement without arbitration I suppose. You could always call them and ask what's up and what this is all about etc. If you offer to work with them then they wont have to contact the third party (which I assume they must pay in some way) and it could be held off for a little bit.
