    rfassett and 727 update

    OK, so I go to the mail box last night and pull out the mail and there is a letter from the U.S. Department of Justice Office of the United States Trustee. If you are familiar with my case you will understand when I say it was one of those letters that you want to open and at the same time you want to throw it down and run away. With trembling hands I opened the envelope and read the letter. Here is the complete letter.

    "Dear Mr. and Mrs. xxxxxxxx:
    Thank you for your letter dated November 24, 2007. Based on currently available information, we do not intend to pursue a motion or complaint at this time.
    We appreciate your cooperation."

    The only letter that I can find that I sent on November 24th is the 4 pound and 13 ounce response to their 727 inquiry which ultimately led to a Rule 2004 examination. I am thinking this is VERY good news, but I am going to contact the DOJ's office this morning to confirm. If it is what I think it is, April 11th can not get here soon enough - just to close this chapter of my life!

      I have been following your case VERY closely because I may be in the same boat as you. I am so happy that the letter said what it did. Sounds like REALLY good news to me. Way to go. Keep us updated if when you call it means something different. I think you are in the clear now though.
      11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

        I just got off the phone with the attorney who took the deposition at the Rule 2004 examination and she said that the letter is just what it says and they are satisfied with all that we wrote, copied and said. So, WOOHOO - look out April 11th, here we come! She, the attorney with the DOJ, has been more than helpful and cooperative at every step and just before we ended the call today, she said, "Good luck to you and your wife"! I think we have a tendency to forget that the trustees and opposing attorneys and judges are just people - doing their job.

            Great news, rfassett - what a relief it must be! You're definitely on the downhill slope to discharge now! Congrats!
