    TTW, you may want to give your attorney a call and ask them to find out why you're still awaiting discharge. You're absolutely right, awaiting discharge is NOT the same as discharge.

    Also, if you can't get an answer from the attorney, you can call the clerk of the bankruptcy court and see if they have any info for you, because it could just be a clerical oversight. But if they can't tell you anything, you have to go through your atty: he or she will need to contact the trustee and find out what the hold up is. Good luck!!!

      thanks we just emailed the attorney

      we were trying to hold off as we have no idea what is left on the retainer. so we try to contact him only every month or so. but i am just getting really upset with waiting so long and feeling like i am in limbo and if it still is waiting for discharge and no one has any idea why i am gonna freak right out !
      i will let you know what he says.

        TTW, don't sweat it. You're well past the point for creditor objections anyway, so it's all but a done deal. Not that I'd be satisfied either! But keep it in perspective. It's like a jockey who's run the race and won, but hasn't finished the trot over to the winner's circle yet. It's all over but the trophy.

        In any case, if your atty doesn't respond to your email in the next couple of days, don't sweat it. Type up a brief letter, sent certified/return receipt requested, that says you have been awaiting discharge for __ days and you need to know what the hold up is.

        I don't know how your retainer with this atty was structured, but if it doesn't include the fat lady singing I would be very shocked. A successful bk isn't successful until it's discharged and closed, and yours isn't there yet, so unless I am missing something very important your atty still has the responsibility of finishing this up for you. A phone call to the trustee or the clerk is not exactly extra work in the same way a creditor objection is, so please don't worry about the retainer. Let him worry about that. Wait for the response from the email, and if it doesn't come, follow up with certified letter: that should be enough to get him moving.

          he emailed us late last nite and stated it appears we have fallen thru the cracks of the system and he is getting more and more of these cases that the court computer doesnt pick up the ending bar date and they go far past it.
          but said there is nothing that we need to be concerned with.
          we asked about our tax refund and if they can ask for that but he didnt seem to answer. my husband could possibly and probably go on strike in august and with my hours cut in december that tax refund is going to be put away for us to actually LIVE off of during the weeks that the strike is on. very scarey. if they can request that and the tax rebate and such we are very screwed. i have no savings. so i cant breathe easy yet, but i feel a lil better, knowing they are not looking for something. thanks for the help. and the good wishes. just hoping to find a discharged and closed date soon !

            Now that you have received a less than satisfactory (IMHO) response from the attorney, if it were me, I would follow up with a call to the bankruptcy clerk to confirm what the attorney said. The clerk's, by and large, are very friendly and very helpful. This should be a a low stress call.

              calling the clerk

              my hub will call the clerk and see what is going on.
              i am just too stressed out to live on .. dont be concerned
              it makes me feel better but the strike worries me and if i can only have one thing to get sick over, i will feel better.

                called the clerk and the discharge occured today

                wow that took forever and its cause of you that it happened as fast as it did. thanks for the PACER and "call the clerk" advice. you guys rock ! i am very relieved now as it has been since last july since filing

                the case is not closed yet when i checked pacer, but it is discharged.

                i still dont know what to do about my taxes. as i had to pay the state but i think i am getting monies from the fed. because of a business loss do i need to wait until the case says closed ???

                    "Follow up and control"! One of the most important phrases known to mankind - IMO.

                    Congratulations on the discharge - that has got to be a gorilla size monkey off your back. Take a couple of deep breathes now and relax. And learn to worry about those things that you can control. That concept comes from the "serenity prayer". There is a lot of common sense and peace to be found therein. Keep your chin up and bask in your newfound victory!

                        No need to worry about the "Closed" - it's just a rubber stamp formality, an administrative thing. Once you are Discharged you are done.

                        Now what you have to do is concentrate on getting into a better financial situation where you aren't relying on a tax return or some other windfall to get you through. Somehow you've got to get solidly on your feet financially because you can't file Ch. 7 again for 10 years!
