    Feel So So Bad - Anyone Ever Have ....

    I met with yet another atty today. The 6th one!

    He states that my wife will definitely be sued and she should definitely file with me.

    I personally guaranteed 715k in credit for my C-corp. I can no longer pay. I live in CA. My wifes info or signature is on nothing that has to do with my corp or debt. We are in community prop state. I have had other atty's say that there's a chance that they will come after my wife. My question to this forum:

    HAS ANYINE EVER HAD A CREDITOR GO AFTER A SPOUSE?

    I WISH I HAD AN IDEA OF THE LIKELYHOOD OF THIS HAPPENING.

    I FEEL SO SO BAD THAT THERE IS EVEN A CHANCE THAT SHE WOULD HAVE TO FILE.

    PLEASE ADVISE

    did you guarantee the 715 before or after you were married?

        as far as I know, any debt or property obtained during a marriage in a community property state is owned by both spouses unless a airtight pre-nup was signed. I say go with the attorney and both file. 750K is a lot of dough to be worried about!!!!

          Thanks for the reply. I never really thought about the amount and having a higher chance of them pursuing her. 750k is a lot and it doesn't include my personal debts.

          Maybe we should. This is really tough.

            I'm no expert but just knowing that CA is a community property state would seem to indicate that your attorney is right - they would come after your wife. She will probably have to file too. You could always call an another attorney and get a 2nd opinion. But it does seem logical that she is likely to be hit up for the debt.

              I was in a community Property state TEXAS urggg!!1 anyway they came after me, start calling my phone harrassing me and threating, when I said I didnt sign for this my husband did, They would say this is a community state blah blah .. soo its true now some place didnt come after me but knowing that you owe 700k they will come after her its too much ( they were coming after me for 3k couldnt sue though because I was poor no home no real money )..they will sue get liens and so forth if you have something.

                Did you file over that? Or were you filing anyway and you happen to have gotten that call?
