Well I had the 341 meeting and my stomach was in knots that night and the morning. I felt like I was driving to the “big house” on the way to see the Trustee.
First let me say the 342 will last anywhere from 5 – 10 minutes. If you are one of the lucky ones you get to listen to all the questions. I however was called #1 so that didn’t help much. All I did was answer Yes-No and that’s on about 95% of the questions. Pretty easy.
What scares me and maybe someone can answer this is why did the trustee NOT take any of my paperwork? I had my bank statements, payroll, 401K, 2007 taxes and he didn’t want any of it. Does this mean I am already listed as an Abuse Case? That kinda freaked me out. I had everything for him so I am somewhat concerned.
I will list some of the questions I was asked by the Trustee. And keep in mind I had a rental house so some questions might not pertain to you.
I now graduated to the 60Day club and as my attorney said before we left, You don’t want to hear from me. Overall I and my attorney were happy.

- State you name and address.
- Do you have proof of your social security number? (I had to show him a W2).
- Have you signed the petition?
- Did you understand the petition?
- Did you read the bankruptcy letter? This was a letter they asked you to read before the meeting.
- Are all you creditors listed on the petition?
- Have you made any payments after the date of filing to the creditors?
- Are there any creditors in the courtroom? There were none thank god.
- What is your primary residence?
- What is the Property Tax Assessed value?
- What is the property value? Here I gave him the appraisal I did in 2005.
- How did you come to these numbers? I basically told him from a licensed appraisal company and comps in the area.
- If we sold the house today would it be worth the loan amount? LOLOL are you kidding in today’s market. Right buddy.
- Are you current via mortgage payments on you property?
- Then he asked the same questions about my rental and if it was in foreclosure?
- Do you owe anybody money?
- Do you have any assets coming in over $500.00.
- Have you filed your 2007 taxes? I said yes.
- Did you receive a refund? I said no.
- How much will you be receiving?
- Do you own your car? This is where I messed up because the Trustee was asking about owning and I said yes, whereas I should have said it is a lease. My attorney corrected us both. Whew!!
- Do you anymore automobiles?
