    The US trustee requested more time to review my case

    Hello. The U.S. trustee in the final hours of my 60 day club, requested from my lawyer a 60 day extension so that he can review my file and possibly use that extra time to object to a discharge. My lawyer granted it. About 3 week later, the US Trustee requested a boatload of bank and credit card statements which I did provide since I did have them. 2 weeks later, the US Trustee requested some more statements as I must of missed a few here and there in the middle and I did provide those as well. Now, the additional 60 days is almost up and a few weeks ago, the US trustee requested more documentation which I did provide again. But this time it was only about 3 bank statements. The weird thing is that I know I provided them the first time and this is like the 3rd time. I guess they got so much paperwork that statements get lost in the shuffle?

    Also, my lawyer told me that this time supply the info directly to the US trustee's office. My lawyer supplied me with the address of the US trustee so I guess they want me to mail it. I would like to know if I can just drop it off in person?

    Yes, you can drop it off in person. But don't expect to sit down and talk to someone.

      I'm in the same boat stressedout. On the last day for objections, my case was extended by the US trustee as well. I haven't heard anything yet but I do know that the US trustee wants to talk to my atty (who is in Utah right now - go friggin figure!) and so I won't know anything until like Wednesday next week. This stinks! I almost want to call the paralegal and demand that the atty talk to the US trustee from wherever she is in Utah and tell me wtf is going on. I just don't even know if I'm in my right mind to be thinking and wanting this. UGH! I'm right there with you about being pissed about this all.

      Just curious but did you have to go back further than the original 6 months of bank statements you provided - like years and years?
      11/14/07 -filed C7 12/04/07 -case pulled for random audit.12/18/07 -341 held: Asset case due to engagement ring & tax return.02/19/08 - US trustee files motion to extend. 04/02/08- changed back to NO ASSET! I get my ring back and get to keep my tax return! :clapping: 04/28/08 -DISCHARGED!!! :yahoo::yahoo: 05/07/08 - CLOSED!!!

        i am in houston as well, and in a chap7, may i ask what trustee you are assigned to? i just had my 341

          Is it common for a US Trustee to push the discharge another 60 days? My god that would kill me!

            What happens if you dont have the documents he's asking for? I have a lot of docs, but if you said give me your discover card statement from 2-31-06 i dont know if i could produce it.....

              I don't think it's common at all for the Trustee to ask for more time. WTF?!

              It sucks even more that they waited til the very last day to tell you, just when you thought maybe you were home free! I'd be really upset.

              I sure hope it works out for you guys. Keep us posted on what happens. What was it that prompted the extensions?

                Pa, my trustee asked for a *boatload* of stuff, but basically I sent what I had and explained why I didn't have what I didn't have in a cover letter. Never heard another word.

                I think that your creditor would be more than happy to give the trustee whatever statements required; in addition to all the docs I provided, I had to sign a release allowing the trustee to access whatever financial information he wanted, which would include credit card statements, bank statements, whatever. So he can get it more ways than one. It's not the end of the world if you don't have immediate access to something.

                My best advice is... wait until you're asked (and it won't be long after you file ), provide what you can, explain what you can't, and make sure you have the legal minimum of 60 days pay stubs and your most recent tax return before you file. (Make sure you have filed all your back taxes as well; for instance if you filed every year but 2005, go ahead and take care of that now, just in case.) You should be fine. Good luck!!!
