    Creditor Filled Notice of Apperaence

    I was looking on pacer and noticed that one of my creditors HSBC filed a notice of apperance. Through some investigation I now understand that means that they have retained a lawyer to represent them in my bankruptcy case. Does this mean that there is a pretty good chance that they will contest?

    Thoughts?

    Probably not.
    Amex did the same in my bk. A Pa. lawfirm. All it means is, they want any correspondence related to your bk directed to them.

      The notice of appearance, itself, is ambiguous. As keepmine pointed out, all it means is that the HSBC will be electronically notified of all documents that get filed in your case.

      Granted, a notice of appearance is the "first" step to further involvement in your case, but the filing, by itself, does not mean anything particularly negative.

      Is HSBC a secured or unsecured creditor in your BK?

        They are both. In fact as it turns out most of my debt is in one way or another linked to HSBC. I have a car loan, 3 CCs, and a loan for some exercise equipment in there. All tolled about 25K (12K for the car).

        Here is why I am worried, I got a new credit card from them (in July) which I used to buy gas (about $300 dollars worth, we literally had 0 money for gas for 2 weeks) and I never made a payment, because shortly after that we decided that we should work towards BK. I stopped paying all my creditors to try and save for the lawyer but I got hit with a garnishment, long story short I ended up spending everything I had saved to pay the lawyer in order to do a emergancy filing and prevent the wage garnishment which would have killed us. What do you guys think is this something to worry about.

          They are not going to object over $300...they probably filed the NOA because of the car, just to keep tabs on the case...and to probably push for a reaffirmation on the car.

            Well, the same thing has happened to me. I noticed today that the furniture company that I owe has filed a Notice of Appearance. They are the same company that I had planned on reaffirming. The same one's that I only owe 6/7 more months on and is secured by furniture.

                Pa, this is the same furniture company that I've been worried about causing me to have to go into a 13. I have continued to make the payments and they are current. This is the same account I had planned on reaffirming. Do you think there will be a problem?

                  With only a few months left, I doubt you'll have any issues with a reaffirmation.

                    Amex filed this on mine as did a collection agency for HSBC. I think they just wanted to know if it was dismissed or anything....so they could pounce. Don't worry about it.
