    Court asking for more information...

    I received an email from the Law Clerk for the Attorney handling my Ch. 7 BK. She said the firm received a letter from the Court requesting some additional information. The Court is requesting the following:

    1. Complete copy of 2006 Tax Return (both Federal and State)
    2. 8 months prior Paystubs (filed 6 months paystubs with petition)

    Since our income in 2006 was greater than $100k, I am being told that this is not an uncommon request. I was told the "Court is requesting this information" -- does this mean the US Trustee is requesting it or the Court?

    This is all I can think about every day and our 341 meeting is not until 3/5/08, so a request for more information concerns me. Is this normal?

    I am sorry I dont have an answer, but I was wondering something... aren't we suppose to give them 2 yrs of tax return and last 6 months paystubs? didn't you already gave them 2006, 2005 tax returns??? or did you give them 2007, and 2006??? I am also watching this post to get answers.. GOOD LUCK and if your attorney is good you will be fine.

      There is no one size fits all rule for everyone. My attorney only wants two years tax returns (he wants 2006/2007) and last four months pay stubs. Trustee could ask for more but I'll cross that bridge when if I come to it.

        Yes, I gave my attorney '04, '05, and '06. Only the first 2 pages of each year's Federal Return. Also gave 6 mos prior paystubs. Court requested the info -- I assume "Court" to mean US Trustee assigned to my case. Had provided 6 mos prior paystubs, they wanted 8 mos, so I sent that in. I haven't done my '07 taxes so I will have to turn that over when completed. I was just nervous that request for more info means bad things to come...can anyone calm my nerves?

          The UST asked us for lots of extra information (like what you have to provide, only more).

          Our lawyer (he is a trustee also) said we didn't have to worry about it.

          Sure enough, we have yet to hear a peep and don't expect to.

          Unsecured Debt Discharged - $162k +/- (small business, personally guaranteed)
          Finally Closed - 3/1/09

              We had to give our 2006 tax return & 6 months of pay stubs. Attorney wanted 2007 but at the time of filing, we didn't have them yet. I'm hoping that because we haven't heard anything about bringing our 2007...we might be in the clear (for tax refund purpose).
