    Trustee asking about taxes

    My 341 isn't until 2/29 so I assume this letter I got is formality, but my trustee is asking for federal, state and property tax returns for the previous year.

    Is he assuming I should have my 2007 taxes filed? I mean legally we have until April right? I have no problem doing the 2007 taxes before 2/29 but curious if I can bring 2006 taxes?

    Thoughts?

    If you have a bankruptcy attorney you're working with, definately ask them this question.

    If you are handling the bankruptcy yourself, definately ask your trustee this question.

    That being said, I believe the way it works is that you have to have all of your tax returns filed that are due, and you have to provide the trustee with either a copy of your most recent tax return, or a copy of the IRS transcript for your most recent tax return. As I understand it, in your situation, since the 2007 taxes aren't yet due, I think you would just provide them now with a copy of your 2006 return. Later on, your trustee will likely want to see your 2007 return because they might try seizing a refund if there is one on it.

    The way this works could vary depending on the area of the country you are filing in, so I definately recommend either speaking with your bankruptcy attorney, or if you don't have one speaking with the trustee.

    Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

      Yes, I do have an Attny and I know he said there is $$ left over in my tax refund via the wildcard exemption. I just don't know how much? Knowing that, perhaps I will get to keep a few bucks :-)
      Thing is, everything is so dark and grey and this BK thing just sucks - plain and simple. How awesome would it be that my Trustee said I could keep the tax refund and upcoming rebate. But these things don't happen to me. And I am pretty much dead-set, I will be asked for everything.
      But like someone said in this forum a week or so back. I have no problem handing over the $$$ knowing my debt is wiped clean, and for good! So perhaps that is the silver lining...

        Don't be hard on yourself, ("but these things don't happen to me"). Do your taxes and you will know and then you can exempt the your return. You have started on the right track and there is a light at the end of the tunnel for you.
