    Went to see attorney today

Well, we took another baby step.

We went to the attorney today, and she was impressed by how prepared we were. It made things so much easier understanding the "lingo", and knowing what to expect before our visit with her.

She looked at our I & J and said that we had about 220 surplus each month, but that with 2 small children, some things could be adjusted up.

Our fee is $1600 + filing fee of $299. More than I expected, but a small price to pay for getting free from our debts.

    What a relief.

We are moving into our apartment March 17th. We will call the credit union this week to see about surrenduring the vehicle. Once we are moved out she said to call our lender and make arrangements to get them our keys and let them know we are surrenduring the house.

We also explained that we NEED our tax refund to move with. She said, "well, if it's gone when you file, the trustee can't take it"

Anyway, thanks so much everyone for your support. We are awaiting our tax money...we will pay our attorney, spend the rest of our money on stuff for the new place and then file.

    Not much longer now.

    Congratulations on the step!

When I read your post, I wanted to mention to make sure you document everything that the tax refund goes toward, exactly. If everything goes toward ordinary expenses, you should be OK like your attorney said. However, if they look at what it went toward and determine that it was for luxury/fun/unnecessary items, they have the ability to make you pay that amount back later.

So, as for "stuff for the new place", make sure it doesn't border on the unnecessary line and you should be OK. I'm not sure exactly where this line is, in the terms of filling out a new home.

Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

I know a woman her spent her tax refund and then filed; the trustee made her pay $1200 of it back because that was the amount that wasn''t covered by exemptions.

When Trustee asked me what I did with my refund, I said "paid my attorney"................. he never blinked an eye about it..... nothing else said...

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.
