    Filing Chapter 7 ; should I pay TeleCheck or bankrupt it?

    I'm filing Chapter 7 as soon as I get over the cold I've had and can look through everything again before giving it to my bankruptcy attorney.

    I'll be getting my attorney's advice on this as well, but wanted to see what everyone's opinions on this board was on TeleCheck so I could talk with my attorney with more knowledge than I have at the moment.

    I just received a settlement offer from TRS Recovery Services, Inc, who claims to be TeleCheck. I had a bank account overdrafted and closed in Oct 2006 with a balance of about $90. They are offering to accept a 65% settlement of about $58.

    The letter states "TRS will consider this matter to be settled and will remove any negative infomration regarding the above referenced debt contained in its National Computer Files."

    I don't have any checking accounts open at the moment, to be able to just ignore TeleCheck.

    Question 1 - If I pay/settle with TRS, do they really remove the entry from their database -- so when I apply for checking accounts in the future, they'll OK it?

    Question 2 - Anybody get TRS to accept less than 65%, instead of getting nothing through a bankruptcy? I haven't tried counteroffering them yet.

    Question 3 - If I include the debt in my Chapter 7 filing, I assume they might give me problems trying to open checking accounts in the future - even though they can't try to collect. Am I right? Is it worth paying the $58 to get out of their database?

    Do yourself a favor. Check everything I say with a bankruptcy attorney. Most attorneys will even provide a free initial consultation. In fact, it's your life, so check everything anyone says (including your attorney) for yourself!

    I would think its worth paying the rather than have that blemish. It will be hard for you to open a checking account with that blemish. I honestly don't know what happens if you file BK on them? Hopefully another will chime in here with better experience. Thats a FIRST for me.

      I and my hubby bankrupt a few tele check accounts and they are old!!! more than 90.00 aswell so they have been on my record forever anyways ,,I have many accounts.. Ing - bank of america - wells fargo ( just got rid of them) and the new addition Wachovia oh yeah and navy federal credit union. I actually i am in a active bk ( not discharged yet and I was approve yesterday for the wachovia.. anyways I just here to say i included them and have had no problem.
      The problem would be writing checks, I dont so i dont have an issue. but I am not sure if you file on them if they would ever take a check from you again ( some merchant have tele check systems )

      then again 58 dollars in nothing.. good luck
