Now UST wants 2007 W-2's. Why???

Our 341 was on 12/28. Prior to the 341, the UST wanted copies of our 2006 tax returns. He reviewed them with us at the 341. He said there was no problem found.

Now I just got a message from my attorney saying that the UST has requested our 2007 W-2's. I haven't been able to speak to my attorney yet, but I'm trying to figure out why he would want them? Is it routine?? Comparing our gross income from 2006 to 2007's w-2's, we earned about $5000 more in 2007. But all the figures on our petition match up to approximately what our 2007 w-2's say.

Any ideas why the UST is now wanting these???

Because W-2 is issued by IRS, and he makes sure no lied & mark-up/mark-down income on I-1040 (07 & 06) & any addditional income hidden (not on 1040) that's all. Just a routine check, no sweat.

Is this one of those "routine" audits to make sure the "t's & i's" are crossed and dotted? Only reason I ask, is that at he time of filing my attorney asked for our 2007 W-2's (which we didn't have) but now we do.

Maybe the new/tough law now requires it. Under old law, I never submit it too, so I don't know now.

No, I have not been flagged as an official "audit". But the UST did send me a letter prior to my 341 requesting tax returns. The letter said that one of the duties of the UST is to investigate BK cases for data accuracy (basically fraud). I called the UST to confirm it I was being audited; he said no, just routine. At the 341, he did question me about the, and he said he was satisfied with my answers, and he 'concluded' the 341.

But now I'm wondering if the W2's are also "routine" requests.

Don'tbother, I think it's becoming more and more routine. About a week after I filed, I got a form letter from the trustee that wanted tax returns and W2s all the way back through 2005 plus MUCH, MUCH more. And that was before he even looked over my filing; it was clear that he sends this blanket request to every filer. If anyone would like to see it, pm me and I will be happy to send it to you, but in the meantime I think W2s are the least of what he could ask for. Also, delving into wage income (the most easily verifiable of all your assets) does not suggest (to me at least) that he is looking for hidden treasure or even fraud. I concur with BKOnce; I think he's trying to square your actual income with declared income.

Please don't worry too much if you can help it. Good luck!!!!
Nolo Press book on filing Chapter 7, there are others too. (I have no affiliation with Nolo Press; just a happy customer.) Best wishes to you!
