Just received our packet from the lawyer and we are scheduled for our 341 on 2/19.
Questioning the amount of property claimed exempt. Our total "value of claimed exemption" is $114,839. The "current value of property without deducting exemption" is $121,519. I see checking accounts, household goods, books, apparel, profit sharing, 401k, autos, our damaged boat and that's about it. Most of it is our 401k & profit sharing in the amount of $88,464.
We are in California and need to know if these figures sound in the "norm" for the Schedule C?
What is the law (C.C.P. 703.140 (b)(5)) regarding this? Can't find it by Google.
We are surrendering our home and reaffirming our (1) car loan and jointly filing.
