    Over Median Income

    Can anyone tell me if they were able to complete a CH7 when they are over the median income? I would really like to hear about your experience. We are between $2500 and $3500 over the median here in Florida (Tampa) of $32,512. We have a family of 4, I have done the means test and we are in the negative of money left over. So if you are in the negative does that automatically mean you qualify for CH 7 or does this make them look at you even closer? Like how are you going to pay for all of your things even if you file? Also, we are filing here in Florida but are using Indiana's exemptions because that is where we lived for the majority of 2 years...Indiana has a higher median income...could that come into play for us or am I splitting hairs here? Thanks to all here on this forum...I feel like I should now have a degree in BK with all of the studying I have done here.

    The median income for a family of 4 in florida is $32,512? That can't be right. Are you sure you looked for a family of four?

    This link says median income is $60K or so... are you sure you are looking at the right thing?

      We were about 30% over the median, and filed a 7. We had no money showing on the I v J comparison, and the trustee didn't bat an eye.

        Sorry, kl, I meant that for the 6 month median income...annually it is $65,000 and change. Wow, kiddles, how long ago did you file? What state? I am hoping that we have a good shot at it since we are so close to the median (stupid number anyway). please share any details that you think may be helpful...knowledge is power!

          We are about 10,000 over median and am attempting to file, we pass means tes I & J are going to be close and maybe a no go if trustee does not allow the xtras we have included in J

            Sly, are you $10,000 over for the year or for the 6 month period prior to filing? I am $3,500 for the 6 month period. If you don't mind me asking...what state are you in? If you are using an attorney, did he/she give you any feedback on your chances of success? Thanks so much...

              10,000 for the year, state of Ohio, yes on attorney. We pass the means OK but we are iffy on I & J. I think it is going to be a coin flip wether it gets through or not.

                We're in a similar position in Florida. Husband makes $63,000 base salary but his overtime came add another $10,000 a year to his income. We are also negative on the I and J. We are just trying to hold down his overtime for a while and then file.

                  It's fitting that we are discussing OH & FL here...the two states primarily responsible for the fact that we are having this discussion at all. I'm in the same boat, a very close case hoping for a 7. Hope we all make it!

                    You say that you are in the negative on J, was that hard for you, we had to get creative, can you share some examples of what you have on J?

                      We filed 11-28-07 in KY. No problems - our 60 days is up in February.

                        We filed 6-30-06 in MI - we were over the median by about 2-3K but our schedules I & J only showed $2.66 left over. The US trustee extended our time frame and we were not discharged for 6 months while they asked for some proof of expenses listed. We were very truthful about everything so it was no problem.

                          Rent = 1600
                          Electricity = 150
                          Water = 60
                          Telephone = 30
                          Cell = 100
                          Home maintenance = 30
                          Food = 400
                          Clothing = 100
                          laundry = 20
                          medical = 100 (prescriptions mostly)
                          transportation = 200 (hubby drives 90 miles roundtrip on turnpike for work)
                          recreation = 50

                          student loans = 75
                          car payment= 390
                          back taxes to IRS payment plan = 263
                          other (pampers, formula) = 100
                          TOTAL: 4,093

                          I know the rent is a little higher than the norm for our area but not by much. Our car insurance is really high too, but that is because my husband needs special SR22 insurance mandated by the state - that's $350 a month. Mine is significantly less. Other than that, we are at or below allowed expenses and still come up short about $200 a month. I suppose they can blink at the $200 for transportation but I have toll receipts and gas receipts - we live 45 miles away from my husband's job - that's like 100 miles a day he drives for work. It's costs money to make money!

                            Can you claim a $1600 rental exense?

                            That seems to be way above the IRS standard.

                              For Palm Beach County in Florida, family of 4, the IRS standard for housing and utilities is $1770. I pay $1600 for rent and another $240 for utilities, bringing me to $1840 - just $70 above. I suppose where you live is makes a HUGE difference in what is allowed. $1600 a month for rent here is not that significant. When I was single and had no kids, I was paying $1300 a month for a decent 2 bedroom apartment with nothing included - no garage, no cable, no utilites. It wasn't a fancy place either - just a safe neighborhood for a single female. We actually LUCKED OUT on this new place for $1600 a month - the housing market is so bad that investors are dying to get people in to rent and dropped prices signficantly. This same place 2 years ago would probably have rented for $2000+/month. I had a friend who was renting a 2 bedroom, 2.5 bath house with a small pool in the backyard. He was paying $4500 a month at the height of the market. Now, it's sitting empty for months.
