Can anyone tell me if they were able to complete a CH7 when they are over the median income? I would really like to hear about your experience. We are between $2500 and $3500 over the median here in Florida (Tampa) of $32,512. We have a family of 4, I have done the means test and we are in the negative of money left over. So if you are in the negative does that automatically mean you qualify for CH 7 or does this make them look at you even closer? Like how are you going to pay for all of your things even if you file? Also, we are filing here in Florida but are using Indiana's exemptions because that is where we lived for the majority of 2 years...Indiana has a higher median income...could that come into play for us or am I splitting hairs here? Thanks to all here on this forum...I feel like I should now have a degree in BK with all of the studying I have done here.

Sorry, kl, I meant that for the 6 month median income...annually it is $65,000 and change. Wow, kiddles, how long ago did you file? What state? I am hoping that we have a good shot at it since we are so close to the median (stupid number anyway). please share any details that you think may be helpful...knowledge is power!

It's fitting that we are discussing OH & FL here...the two states primarily responsible for the fact that we are having this discussion at all. I'm in the same boat, a very close case hoping for a 7. Hope we all make it!

We filed 6-30-06 in MI - we were over the median by about 2-3K but our schedules I & J only showed $2.66 left over. The US trustee extended our time frame and we were not discharged for 6 months while they asked for some proof of expenses listed. We were very truthful about everything so it was no problem.Filed Chap 7 6/30/06 - 341 Meeting 8/1/06 -

Rent = 1600
Electricity = 150
Water = 60
Telephone = 30
Cell = 100
Home maintenance = 30

medical = 100 (prescriptions mostly)
transportation = 200 (hubby drives 90 miles roundtrip on turnpike for work)

I know the rent is a little higher than the norm for our area but not by much. Our car insurance is really high too, but that is because my husband needs special SR22 insurance mandated by the state - that's $350 a month. Mine is significantly less. Other than that, we are at or below allowed expenses and still come up short about $200 a month. I suppose they can blink at the $200 for transportation but I have toll receipts and gas receipts - we live 45 miles away from my husband's job - that's like 100 miles a day he drives for work. It's costs money to make money!
