    If you have PACER it's definitely worth the $2.40 it costs to look over his schedules.

    Was he the same one involved in the Duke LaCross incident? The former district attorney? Did this BK actually get discharged or may it get converted to a 13? That seems almost absurd to be able to do a 7 that much over the median.

        It looks as though he can't file for a 13. It also appears he is keeping his mountain property...go figure. On form 22A it shows his disposable income over $900. Am I missing something, or do you take the disposable income from schedule J? His schedule J shows a neg dollar amount.

          Correct, disposable income comes from Schedule J. The means tests is to only see if your case will be presumed abusive (i.e. if you are above median income, etc), but your actual expenses (assuming they are reasonable), can rebut that presumption.

            Actually, that raises a question: he's filing Ch7 now, but the three players have each declared their intentions to file civil suits as well. I don't recall hearing about any judgements in those (IF they have actually been filed yet) so would declaring Ch7 make him immune to future judgements based on a pre Ch7 event?

            If not, seems like he should hold out and wait to receive those civil judgements, but who knows. That whole thing had no winners. What a sad affair.

              Things like this are considered unliquidated/contingent libilities and can be discharged in bk regardless if a lawsuit has been filed or not.

                      I hope he gets our trustee. . .

                      I am in Easter district and have had a doozie of a trustee. May Nifong be graced as I have and we make well below the median.

                        Guarantee that 341 won't be like most of ours, 10-12 people, 3 lawyers and a trustee.

                          I just looked at it. I lived in NC while this was happening and he was such a psychopath!

                            Boscoe, he filed yesterday, 1/15/08. Middle District of NC.

                            Yeah, I never could understand why either. I'm thinking maybe he has some health issues or something, even if it's just mental health, because it just seemed so extreme and it's not like he even really tried all that hard to hide what he'd done. What he did was stonewall, but not actually conceal, which is either very stupid or very arrogant, given that everything the young lady said to the police was accessible by the defense, but... what do I know?

                            I dimly remember that the year before this, the year he got re-elected, there was a very strong grassroots movement in Durham, complete with petition, to get someone else on the ballot to challenge Nifong. It was kind of a footnote to local news, and then completely dropped off when he got elected. I wondered why there was such local opposition to him at the time; I guess we all know now.
