First of all thanks BKforum.com for existing, you have comfort a lot of my unsettling questions. Well I have been checking on my claim register everyday and my credit report on truecredit.com everyday. But something happened today (01/11/2007).
I received a letter from a Bankruptcy Analyst of the U.S. Trustee office. It says the following.
1. Schedule J lists car payment of $2,000 per month but schedule B lists no cars as assets. Also Schedules D and G lists no car loans or leases. Please explain and if necessary, file amended bankruptcy schedules.
2. Statement of Financial Affairs question #1 indicates that you have no income in the past three years. Is this correct?
3. What is the status of your mortgage? The parments are $5,000 permonth. How have you been paying it?
4. Please provide us with a copy of lawsuit that led to the judgment which was entered on or about February 21, 2007.
5. No bank accounts are listed on Schedule B. Is this correct? what was the name and location of your last bank account?
6. Please provide your 2006 income tax returns to our office, as well as the Chapter 7 trustee. This is a requirement and the trustee is actually supposed to received it seven days before your meeting on Jan 23, 2007.
For #1: I have non listed in the schedule because since I filed pro se, I didn't know that it is important that I file jointly with my wife. and on Jan 2, I have filed amendment and from what the bankruptcy analyst on this letter on Jan 11 it didn't reflect any of this information.
For #2: I truly have no income for the past three years mainly just working on some projects to try to start a business but have been relying on my old saving prior to that and borrow money from relative. I have tax filing to support those am I okay with that or do I need more?
For #3: We are late for 2-3-4 months now and we are prepared to pay however much when we get my wife's tax return and sell the house.
For #4: Do I still need to give them the copy of lawsuit that led to judgment since judgment was entered and case closed. I have also remove it from the schedule from filing amendment on Jan 2. Its a breach of contract judgment from the place I work commission on and was included in law suit.
For #5: I followed instruction from an online filing place but, I guess I will just give it to them since there are no money for the past god knows how long.
For #6: My wife and I filed jointly so I will provide that to them. I have no income from that anyway.
Gentlemen and Ladies, please let me know how do I respond to them.
